Notices of Violation <br />NOV-CV2009001 - Failure to Minimize Erosion and Resultant Siltation beyond the Disturbed Area. <br />- Issued 2/27/09 <br />- Terminated 3/5/09 <br />- Paid civil penalty of $250.00 <br />Section III - Reclamation Liability <br />The Division is holding three corporate sureties as the reclamation bond for the Bowie No. 1 Mine. <br />1. Corporate Surety No. for $2,500,000, issued by the Lyndon Property <br />Insurance Company. <br />2. Corporate Surety No. for $2,500,000, issued by the Lyndon Property <br />Insurance Company <br />3. Corporate Surety No. for $761,290, issued by the Lyndon Property <br />Insurance Company <br />The Division's permitting system shows that the current reclamation liability at the Bowie No. 1 Mine is <br />$4,674,215.00. The Division is holding sufficient bond in the amount of $5,761,290.00. <br />The Division is in the process of reviewing the reclamation cost estimate for the Bowie No. 1 Mine, as part of <br />the midterm review. When the results of the review are known, BRL will be notified. <br />Section IV - Adequacy Review <br />The following are the Division's adequacy review questions and comments: <br />1. Please update Section 2.03.4, Identification of Interests, of the permit application if applicable. The <br />updates should include corporate ownership and control information as well as surface ownership <br />information. Also, please update the appropriate surface ownership maps, if applicable. <br />2. Please expand the discussion on permit application page 60a of Section 2.05 to include a description of <br />the use of coal waste and soil material in accordance with MSHA requirements in the sealing of the <br />West Mine fan shaft. <br />3. Please update the discussion on permit application pages 60b and 60c concerning the reclamation <br />progress at the East Mine and at the timber storage area. <br />4. As mentioned in the previous findings section, the Division has not finished its midterm review of the <br />reclamation cost estimate. The Division will send BRL a copy of the cost estimate when it is finished so <br />that BRL can review it and provide comments. <br />5.
