Pifieda <br />8120 Gage St. Director <br />Frederick, CO 80516 <br />RE: Heintzelman Project (Pit 116); DRMS File No. M-2009-018; October 4, 2010 Meeting <br />Summary <br />Dear Mr. Varra, <br />This letter is being sent to summarize the meeting held on October 4, 2010 at the Heintzelman <br />Project - Pit 116 (Heintzelman). The meeting was attended by Michael Cunningham and Tony <br />Waldron of the Division of Reclamation, Mining and Safety (Division). Also in attendance were <br />Chris Varra, Garret Varra, Brad Janes, and Brad Jones of Varra, Inc. The meeting was held to <br />discuss the proposed conveyor route, which would extend north from the Heintzelman site to the <br />Kurtz Resource Recovery and Land Development Project (Kurtz), DRMS File No. M-1999-006. <br />The proposed conveyor route would also cross through the affected area of the Nix Sand & <br />Gravel Mine (Nix), operated by Ready Mix Concrete Company, DRMS File No. M-2001-046. <br />Based on the discussion with Varra, Inc. and observations made in the field, the Division has <br />determined the proposed conveyor route will require the following submittals: <br />Nix Sand & Gravel Mine: <br />The Operator shall submit a request for an acreage release pursuant to Rule 4.14.1, to release <br />the portion of the permit area along the west side of the permit boundary, through which the <br />conveyor will run. The request should include a map which depicts the legal description of <br />the area to be released. In addition, the submittal should include Mining and Reclamation <br />Plan Maps showing the location of the revised permit boundary and the revised location of <br />the reservoir(s). <br />In accordance with Rule 6.4.19, both Ready Mix Concrete Company and Varra, Inc. shall <br />provide a notarized agreement stating that should either mining operation adversely affect the <br />stability of any significant, valuable and permanent man-made structure within the other's <br />permit area, up to a distance of 200 feet from where the permit boundary meets, that <br />compensation shall be provided by the responsible permittee. <br />a4 1-4) <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
