Note: The Division of Minerals and Geology ("Division") shall not be a party, but shall <br />participate in the hearing as staff to the Board. <br />III. ISSUES TO BE CONSIDERED <br />:Presentations to the Board shall be strictly limited to the issue of whether the pending application <br />complies with the requirements of the Colorado Land Reclamation Act for the Extraction of <br />Construction Materials, Sections 34-32.5-101 et seq., C.R.S. (1999) ("Construction Materials <br />Act") and the rules and regulations promulgated by the Board. The parties shall limit <br />presentations to the question of whether the pending application should be approved or denied, <br />based on the issues stated below. <br />Maps <br />Are maps adequate regarding the following: <br />Presented at the scale specified in 6.2.1(2)? <br />Include adjacent landowners as required in 6.3.1(2) and 6.4.3(a)? <br />Delineate topsoil stockpile locations and development contours on the mining <br />plan map? (6.3.5(2)) <br />Provide vegetation detail, location of plant site and post mine topography on <br />reclamation plan map? (6.3.5(3)) <br />Timing of mining and reclamation processes <br />2. Has the operator provided an approximate timetable to describe the mining operation for <br />the purpose of establishing the relationship between mining and reclamation during the <br />different phases of the operation? (Rules 6.4.4(e) and 6.4.5(e)) <br />Backfilling <br />3. Does the applicant ensure the backfilled material will be adequately compacted for <br />stability of the backfilled material? (Rule 3.1.5 and 3.1.5(9)(f)) <br />Blowing <br />4. What measures will be taken to effectively control wind erosion on all surface areas of <br />the affected land? (Rule 3.1.6(6)) <br />Water Information <br />5. Does the application provide adequate information to determine the effect of the <br />operation on the quantity and quality of the St. Charles aquifer and the underlying <br />aquifers? (Rules 3.1.6 and 6.4.7) <br />6. Has the applicant established groundwater points of compliance? (Rule 3.1.7)
