September 23, 2010 C-1981-019/Colowyo Coal Mine JRS? <br />- Colowyo has completed the backfrlling and grading of the R3 coal stockpile area. The area is approximately <br />seven acres. Colowyo will replace topsoil and seed this area once they receive results from the overburden testing <br />(assuming the results come back acceptable). <br />EXCESS SPOIL and DEVELOPMENT WASTE - Rule 4.09 Placement; Drainage Control; Surface <br />Stabilization: <br />- Colowyo was actively dumping on the B-B' underdrain area of the West Taylor Fill. They are currently working <br />on the third lift on the pile. There was no active dumping on the A-A' underdrain area of the West Taylor Fill and <br />it remains as it has for most of the summer. Both areas appear to be stable and no water was pooling on either- <br />portion of the fill. <br />- Colowyo was also dumping on the C-C' underdrain area of the East Taylor Fill. The dumping was occurring in <br />the front of the pile (north side of the pile) where the rock crusher used to be located (before being moved into the <br />South Taylor Pit). The East Taylor Fill appeared to be stable and there was no water pooling on the top of the fill. <br />HYDROLOGIC BALANCE - Rule 4.05 Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water <br />Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage - Acid and Toxic Materials 4.05.8; <br />Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />- Colowyo was working on breaking rock and recutting the lower portion of the Final East Pit Ditch, as required <br />by NOV CV-2010-004. The majority of the rock has been broken down to a much smaller size. They were also <br />working on breaking the rock in the North Tributary, East Pit Ditch. The Division has approved Colowyo's plan <br />for reconfiguring the upper portion of the North Tributary, East Pit Ditch so Colowyo can begin work on that ditch <br />as well. The Division will evaluate whether Colowyo has constructed these ditches according to design when all <br />of the work is completed. <br />- Colowyo has completed the ditch work on the lower approximately 1,500 feet of the Taylor Tributary Ditch. <br />This work included breaking and respreading the large rock in the lower portion of the ditch and recutting the <br />ditch. Colowyo has also completed new construction of the upper portion of the Taylor Tributary Ditch to the <br />southern edge of the 2010 West Pit reclamation area. The Division will evaluate whether Colowyo has <br />constructed this ditch according to design when all of the 2010 ditch work is complete. <br />- The West Taylor Pond contained water approximately eight feet below the top of the discharge pipe and was not <br />discharging at the.time of the inspection. During the Division's 18 August 2010 inspection it was noted that the <br />West Taylor Pond was discharging even though the water level was approximately four feet below the lowest <br />weep hole. The pond was included in Notice of Violation CV-2010-004 (for failure to properly construct and <br />maintain a sediment pond). Colowyo stated that they drained the pond to a point below the junction of the riser <br />pipe and the pipe that goes through the embankment (through the gated valve). They caulked the pipe and <br />tightened the collar. Based on the fact that the pond was not discharging at the time of the inspection, it appears as <br />though the leak in the pond's riser has been fixed. Based on abatement step 3 of CV-2010-004, Colowyo must <br />provide the Division with a written report documenting the problem with the pond and the solution.
