It must be reclaimed to as good as or <br />better than it was and this cannot ever be done with 190,000 tons of our prime soils gone. <br />And as a result we have suffered irreparable damages to our property and to the landowner <br />and. others. We are again asking for relief for the damages that have been done. As to <br />Western Fuels, whom I was working for, knew for fact that this was Prime Farmland and <br />knew for fact that this area contained Barx soils, and knew for fact that Mr. Morgan was the <br />largest shareholder., and knew for fact that we produced cash crops only, and ,knew for fact <br />that we had consistently irrigated this property all the time that they had arrived in the area, <br />and knew for fact that they had told all of us that it would be put back as good as or better <br />than it was right behind the tninimg. Omission of all of these facts to the Division is a serious <br />violation and has caused irmparablc damages to the land and to the landowner. <br />At first, the Division was thorough. and consistent with all of their program until. Western <br />Fuels allowed Ross Gubka to do the permitting and everything changed. Harry Ranney was <br />consistent and thorough until that point also. From 1997 on, it went downhill. 'hank you for <br />your time. I am not going to stop with my complaints and I am going to continue until some <br />relief is given. We have lost most livelihood for these damages that have been done to us and <br />it is not right that a State Regulatory program that is designed to took after the landowners <br />and land owner rights would allow for so much damage to be done. I hope that the Federal <br />Government car; now clearly see what has happened and maybe with the expertise of a farmer <br />oriented person from OSM, you can see for yourselves damages have occurred and they <br />cannot be just swept under the table. We are real live people with real live damage. Thank <br />you again. I believe in my heart that if a proper investigation is done that you will see that <br />these facts are undeniable and many other violations were done by Western. Fuels that I will. <br />show in further documentation.
