(6 1) After the 2008 meeting, they slammed us with changing what has now been determined as <br />Prime Farmland, to change half of our property to dryland. The Division offered no help here, <br />they fought side by side with Western. Fuels to change our property to dryland until after bond <br />release which we could at that time put it back into crop land. Again, a total. violation of rules <br />and regulations. Even after our public meeting where we presented all the facts, they continued <br />to fight month after month. to put our property to dryland. Historically irrigated. and cropped for <br />59 years with 50 shares of water, to dryland. The most productive farm in this area. <br />(62) They documented numerous areas East of 2700 Road where one share did two acres of <br />property. 1 gave Marcia a. letter from every rancher here documenting one share did. 2 acres and <br />we were totally ignored and no one listened until I finally got Mr.. Berry. <br />In conclusion, The Division. did not protect the landowner and the landowner rights. The Mine <br />operator furnished erroneous documcntation and omission of important facts. Public <br />involvements nor. landowner involvement was allowed unless an objection was .fled and Western <br />Fuels would not allow that. Technical Revisions and Minor Revisions were done causing <br />irreparable damages as well as being illegal and not giving the landowner and opportunity to <br />object or show them what was wrong. Marcia Talvitie specifically told all of us at the dining <br />room table that if we had objections that they had to be submitted by the landowner and signed <br />by the landowner. When Western, Duels was asked. to stop removing our Prime topsoil. and <br />hauling it off: they replied" This is a, communist State, those who have give, those who don't, <br />take. A negative Prime Farmland determination can only be made with written request from the <br />operator and proven beyond a doubt. A positive determination was made early in the permit <br />documenting that BARX soils are ;prime farmland soils and to incorporate a positive <br />determination into the permit. This issue was addressed numerous times leaving no room for <br />error.. The expertise that was needed regarding Prime Farmland area and irrigation from the <br />Division. was not sought or provided for the ;protection. of the landowner. When we talked with <br />the Division in 2008, they had never seen a side :roll, they did not know how a center pivot <br />works, nor did they understand what a traveling big gun or gated pipe was. We should have been <br />given more care and consideration since we were the largest producers in this area.. The Division <br />is still using the word "flood" irrigation which is a sheet of water across the land and we have not <br />flood irrigated for 39 years and they refuse to use anything we say. The Division is not listening <br />to the landowner. IFNRCS does not tell them ward for word they will not accept anyth,irig we <br />tell them. We can not grow corn. under a sideroll and this place can never be furrow irrigated as <br />it was. <br />If we could, please beg you to come and actually sit down with us and tour with us, we can prove <br />all of this. Mr. Berry refused to come for whatever reasons for months and months and months,.i <br />begged. He had done so much to put it back on the right track, but his personal involvement was <br />needed and he .refused. Letters, phone calls, etc. are not the answer here. We need to be able to <br />show you all of this. If Mr. Berry would have given us an opportunity, most of this could have <br />been resolved right. We have lost part of our livelihood, our property, our production, and we <br />have been h.indcred for years. This is not our fault. If they would have.nni:ned, put back our soils
