October 5, 2009 <br />Colorado Department of Transportation <br />Attn: Utility Permit Office, Region 2 <br />905 Brie Avenue <br />Pueblo, CO 81001 <br />Re: JBS Five Rivers Cattle Feeding, LLC <br />Colorado Beef Feedyard - Water System Improvements <br />Highway 50 Boring Preliminary Approval Request <br />Dear Mr. Mark Plusskern: <br />JBS Five Rivers Cattle Feeding, LLC - Colorado Beef Feedyard is requesting to bore under U.S. <br />Highway 50 in two locations, both approximately 274 ft. east of mile post #427. <br />Per our telephone conversation in January of this year, enclosed please find the plans and <br />specifications for this project. Colorado Beef has contacted us to provide the necessary design <br />information. It is our understanding that upon a review of the plans and specifications that a <br />"Prel urinary Ap iu oval' letter will be issued. For the issuance of a Special Use Permit, the <br />Owner or Contractor shall submit the Utility/Special Use Permit Application, along with the <br />preliminary approval letter, plans and specifications, and additional information per the <br />application requirements. <br />Since our first conversation we have completed the plans and specifications and have <br />communicated with the necessary clearance contacts. The agencies and personnel contacted <br />were the Water Quality Manager, Rick Willard; CDOT Property Manager (Asbestos), Theresa <br />Dreiling; and Colo. Dept of Health, David Knope. We contacted these agencies via telephone <br />and explained the proposed scope of work. They indicated that they had no reason to be <br />involved in this nature of work. <br />We also contacted the Colo. Historical Society, Mark Tobias; Army Corps of Engineers (Van <br />Truan) and Colo. Division of Reclamation, Mining and Safety (DRABS) (Anthony Waldron). We <br />had several phone conversations with the Colo, Historical Society. They verified that an <br />Archaeological survey would be required if records indicated findings in the area. The survey <br />would then verify whether or not construction activities would be affected. We received letters <br />fiom the Army Corps of Engineers and DRMS; copies of the letters are attached. The Army <br />Corps of Engineers verified they have no jurisdictional waters on the site.
