The Applicant has indicated 362,640 LCY of material is required to backfill the reservoir. <br />Please indicate if this is the amount of material required to backfill the fully excavated <br />reservoir or the current disturbance. The Division calculated the amount of material required <br />to backfill the fully excavated reservoir to be 701,777 cubic yards. Please revise the amount <br />of material needed to backfill the site in Exhibit L or provide justification for using a <br />different figure. <br />The material to required to reclaim the reservoir has been revised to show that the material <br />needed will be 72,254 loose cubic yards (LCY). This will be added to the volume of <br />material to reclaim the affected area of the permit of 174.6 acres. Supplemental work sheets <br />(2 ea.) marked as "Exhibit "L" Estimated dated October 6, 2010. The applicant has also <br />calculated the total LCY for item 4 of the reclamation cost included with the Division of <br />Reclamation, Mining and Safety (DRMS) submittal. The amount is for the proposed <br />reservoir at the full depth and length and width. Since this mining project is primarily a <br />reservoir construction project with the excavated material becoming a surplus material, <br />which will be processed, to produce construction aggregates. This project is not a phased <br />operation the mining is for all intents and purposes part of the construction process. The <br />rational for the applicants approach in regard to the reclamation is that the majority of the <br />excavation will be during the construction of the reservoir at its deepest elevation. Since <br />this reservoir is a planned project with the plans and specification for the general contractor <br />to follow the pit will not be any larger than shown on the plans. Thus, with the 4 horizontal <br />to 1 vertical slope called out in the plans, mining will not vary as designed and the mining <br />will be done to meet these specifications. The applicant has stated no ground water will be <br />encountered at the deepest elevation the reclamation would be dry. The reclamation could <br />start at this point, which would be at the maximum depth. The applicant would then start to <br />replace the material to accomplish the reclamation as outlined in the reclamation permit. <br />3
