This is the SECOND letter that I have sent you a copy of. The first is also <br />included. Prior to that several years ago, there are more. There are also more verbal threats prior <br />to that. You can speak with many other farmers and when I have a summons served to them, you <br />will see. Mr. Morgan never filed the objection, to PR-06, when they started their threats, I did. I <br />am the one who first called the Division because they were scared to death to call. I lease this <br />place and so does Michael and we have all the farming rights and every right to file what ever <br />objections is needed to protect this place. <br />I have COURT documentation where you have allowed Western Fuels to take historically <br />irrigated cropland and turn it into dryland NUMEROUS times now. Historically irrigated <br />cropland is documented as being historically irrigated and cropped 5 out of 10 years prior to the <br />lease or purchase, not when they decided to enter the property and mine that property, but 5 out <br />of 10 years before they leased or optioned the property. Then your laws state that it must be put <br />back as good or BETTER than it was. Instead now we have 100's of acres of DRYLAND in this <br />area because you allowed them to do whatever they wanted and NO ONE HERE CAN OBJECT <br />because THEY ARE THREATENED and most cannot afford attorneys and they do not know <br />that they even have any rights. Your rules and regulations state that there will be PUBLIC <br />participation and PUBLIC involvement and this DOES NOT MEAN THAT AN OBJECTION <br />NEEDS TO BE FILED. This means that this public participation will be made available to the <br />public so we can just discuss without objections and in 18 YEARS, THIS HAS NEVER BEEN <br />MADE AVAILABLE AS YOUR RULES AND REGULATIONS STATE. <br />When the State showed up for the informal hearing that I asked for, I told all of you and Western <br />Fuels that we are and have been done very wrong here and we were just ignored again and told <br />"Oh well, that's past". Well, here it is, happening again. <br />We have been told several times to get an Attorney. We can't afford an Attomey. We had no <br />other choices other than to represent ourselves. However, several Environmental Protection <br />groups out of Telluride and Montrose have now contacted us. Television stations and two major <br />newspapers have also contacted me wanting the entire story. They believe that they can help us <br />get an Attorney on a contingency basis and help us fight this. They believe if 1 get this all out to <br />the public on Television and in the Newspapers, help will arrive. Anything is worth a try <br />because we are not going to allow for our Prime Farmland to be destroyed as it has been and ruin <br />the farm that once was because the people here are afraid. <br />And WFC, at minimum, have imperiled our livelihood, our lives, and our job.
