10/0412010 08:43 FAX 970 865 2675 VISTA REALTY LA1416 '-Ocf(-?) 1A 001/007
z 1.2--• ca
Mr. David A. Berry
Office of Land Management
Division of Reclamation, Mining, and Safety
1313 Sherman Street, Room 215
Denver, Colorado 80203

a n
October 4, 2010
- . f J

Dear Mr. Berry:
fi ?d
c),4 4, zfl ic)
(a) 830' Siob
z?b
?`6C-T ?r
9
We have tried to explain how the Federal and State Rules and Regulations governing Surface
Coal Mining has been violated by Western Fuels in the past and now even today, again, they are
being violated.
Western Fuels sign ]eases with the older population here, 60, 70, 80, 90 years olds that have
farmed here their entire lives and provided a living for their families their entire lives. They then
are threatened by Western Fuels and scared to death to even do anything. We are not the only
ones that have received letters like this or phone calls that tell us that we have no rights and to
shut our mouths.- As well as for Michael, who is a board member, to recuse himself firom the
Board. But, WFC employees, people they have leases with or are trying to get a lease with, San
Miguel Power Employees, or Power Plant Employees, are or have been Board Members and
have never been told to recuse themselves. And Mr. Morgan is the largest share holder.
All of your rules governing civil rights and citizens rights are being violated, again,. We are
given those rights along with numerous others under your rules and regulations. We are suppose
to be protected under those regulations to the fullest extent of the law. We have also been given
the right to file and pursue objections when violations are being done as well as if we are
adversely affected by the actions of the surface coal mine.
These Rules and Regulations are as valuable as any Rule or Regulation that you have. There is
not ONE Rule or Regulation that is MORE important than another. They are all of EQUAL
value. The operational Rules and Regulations are no more important or no more valuable. All
are just as significant and work hand in hand.
All of you write many times, 'No objections were filed or noted". This is WHY. All of us over
here have been told or threatened with lawsuits, breach of contract, no royalty payments, or
worse. These people are farmers. These people are mostly old and do not have a clue how to
fight or respond to such threats. Royalty payments have ceased here and there will be no more
mining of the Morgan property and definitely no more soil re-distribution until we get to speak
with a Judge or Mediator because our civil rights have been totally violated under Federal and
State Rules and Regulations, We are not going to allow for anymore of our soils to be stolen
