Buffer Zone for Stability. <br />Regarding mining near the 25 foot buffer zone around power poles - these power <br />poles are being relocated by Tri-State Generation and Transmission Cooperative <br />to the south property boundary line. Tri-State's project first commenced June, <br />2010 and new poles are now up. Also, we received word from Tri-State earlier <br />today that wires from the old poles and the old poles that ran through the <br />permitted area have now been removed. <br />4. Trash Deposition. <br />At the time of purchase of the Gleason Pit, there was a very large accumulation of <br />trash which we have been working on regarding removal of same and will <br />continue to work on until completely gone. <br />Regarding the pile of wood, it is in San Miguel County on the old portion of the <br />permit that was mined years ago by San Miguel County and is not within the <br />existing permitted area. The pile of wood is being used for fire wood and when <br />used up, we intend to slope, backfill and reclamate the area. <br />5. Reclamation Liability/Bond Increase. <br />I am somewhat confused regarding the reference in your letter that "the site is <br />clearly under-bonded". As I am the owner of the property and it is my <br />responsibility to take care of the various items addressed in the inspection report, <br />including defraying the-costs-of reclamation of the property, I don't understand <br />why the bond should be increased. At the time that we originally leased the <br />gravel pit (2004) and then subsequently purchased the gravel pit, the amount of <br />the bond was $18,573.00 and it was my understanding at that time that the amount <br />of the bond would not change. <br />Sincerely, <br />Jim Sutherland <br />S & S Aggregate, Inc.
