AGGREGATE <br />INDUSTRIES <br />Mr. Jared Ebert, Division of Reclamation, Mining and Safety <br />September 29, 2010 <br />Page Two <br />engineering evaluation. The engineering evaluation was conducted by Haley & Aldrich, Inc. <br />(now known a Lyman Henn) and submitted to CDOT on March 28, 2001. According to the <br />evaluation report, a copy of which is enclosed for your reference, a copy was also submitted to <br />the Division. The evaluation demonstrates that there will be no structure damage resulting from <br />activities occurring at the mining operation. Neither CDOT nor the Division responded with any <br />comments regarding the evaluation that was submitted nine years ago, and Al therefore believes <br />that the evaluation as submitted satisfies the requirements Rule 6.4.19 and should not be required <br />to be re-submitted as a technical revision. <br />Al respectfully disagrees with the inspection report indication that Al has affected land within <br />200-feet of Greeley Gas Company. According to title and survey information, the Greeley Gas <br />Company gas line does not lie within the property boundary and there is no indication in the <br />permit documents that a gas line is located within 200-feet of the permit boundary. The marker, <br />which is referenced in Exhibit S of the permit and is denoted on the survey appearing on permit <br />Exhibit C - Pre-Mining Plan Map, is in the far northeast corner of the permit boundary and <br />approximately 1,000-feet from AI's current limits of mining. Dependent upon GURA's decision <br />regarding the slurry cutoff trench, mining may never occur closer than 200-feet from this <br />structure and Al proposes to submit the appropriate structure agreement or engineering evaluation <br />at such time when a decision is made that would result in mining closer than 200-feet. <br />With regard to the Division's direction to submit a technical revision to "update and improve" the <br />current approved ground water monitoring plan, Al is proposing to incorporate data collected from <br />monitoring wells associated with another mining operation in the vicinity. The proposed plan will <br />be submitted under separate cover as a technical revision and we are requesting a 30-day extension <br />of time to October 30, 2010 to allow for submittal of the revision request and review by the <br />Division. <br />Thank you for your consideration in these matters.
