Not a <br />farmer we know, a farmer from your area and ask there what is wrong with it. <br />We have said over and over Ishare will. do and has done 2 acres all of our lives as well as the <br />famers in this area. If you will read the lease agreement on. the water signed by Western Fuels, if <br />is 60 shares according to MORGANS calculations and how MORGANS irrigate. The water is <br />not a problem and has never been a problem. All of them made it a problem, along with DRMS. <br />Have any one of you actually read the Rules and regulations and know why they were written to <br />cover the entire state of Colorado and what they realty say? They were not written for Nucla, <br />Colorado, they were written for the entire state and that is why they were written the way they <br />were, Prime farmland criteria has been distorted as well as the National Soil Survey Handbook. <br />The reason it is so easy for us to see and understand is because we are farmers and have been our <br />entire lives. <br />Greg Lewicki states that we asked a ridiculous request in our settlement offer. Has anyone in <br />your office or in their office priced BARX/DARVEY Prime farmland soils in. that quantity and <br />got a figure with hauling and without hauling. First Prime f inland soils in that quantity are not <br />available any where in this area and Barx/Darvey is one of the very best prime soils and cannot <br />even be found anywhere to evert begin to replace what they have stolen. We have called and <br />consulted all over the country. We also know that what most places call top soil, is just soil that <br />has been sifted through a fine screen to remove rocks, but does not qualify for prune and the <br />quantity is still not there. So, before anyone makes a statement like that, you can see for yourself <br />that prime Barx/Darvey topsoil costs more than what the coal cost and is as valuable to the <br />farmer as coal is for an energy source. And Greg Lewicki failed to mention that even though the <br />people get royalties off the coal, the coal is not then free and in fact is much more than what they <br />paid for, it. This man thinks that this thine came in and helped all of us poor farmers when in fact <br />because of the time frame that has been spent on our place has costs us much more than what the <br />coal is worth and if we had to do it all over again and know what we know, it would. not be done. <br />Mr. Berry, you gave me your word that you would help straighten, all of this out if we would do <br />our part and put down how we wanted it and what it should be. Greg Lewicki needs to <br />understand that we had Prime Farmland, all in crops, and full production before the mine entered <br />this and that we were the largest producers of crops in this entire area making a substantial living. <br />Largest shareholder of water. We have farmed our entire lives and we are not new at this game <br />and pretending to know something about farming as they do. The Rules and Regulations <br />governing surface coal mining is very specific about the rights of the landowners and the <br />protection, of the landowners to the fullest extent of the law from the adverse effects of mining, <br />All reclamation must conform to the landowner plazas as well as written consent from the <br />landowner for any changes that may affect his property. Everyone here cannot keep stealing <br />from. Peter to pay Paul. We are Peter and I have sent you pictures of how deep our A lift, B Lift <br />and C lift are and we want all. of our topsoil put hack -And, since they stole 51 acres, as I stated <br />before, someone needs to make compensatioio for our soils that were taken from us before we can <br />proceed with a plan. to reclaim and redistribute the topsoil. Western Fuels admits to taking this <br />soil in PR-06 and they need to compensate the Morgans for this theft and no more theft is going <br />to occur on this property.
