May Day and Idaho Mine Complex 112 (d) Permit Application (7) Groundwater Monitoring: Groundwater monitoring will be undertaken in accordance with Subsection 3.1.7(7) of the Mineral Rules and Regulations. (8) Release of Reclamation Liability: Wildcat will demonstrate, to the satisfaction of the Office, that reclamation has been achieved so that existing and reasonably potential future uses of groundwa- ter are protected. (9) The Office will be supplied with a written report within five working days when there is evidence of groundwater discharges exceeding applicable groundwater standards or permit conditions im- posed to protect groundwater quality when these other conditions are explicitly identified in the permit as requiring such notice. • Rule 3.1.8 Wildlife (1) All aspects of the mining and reclamation plan have taken into account the safety and protec- tion of wildlife on the mine site, at processing sites, and along all access roads to the mine site with special attention given to the Canada lynx which is a Federal and State listed endan- gered species known to inhabit this area and to not disrupt migration patterns of deer (Exhibit H). This is especially critical during the winter season with considerations of snow removal or compaction disrupting lynx movement and hunting grounds. (2) Habitat management and creation is not part of the Reclamation Plan or planned future land use. • Rule 3.1.9 Topsoiling (1) Since this is an underground operation, relatively little (less than 10,000 cubic yards) run of mine rock is expected to be disposed of in designated storage areas. In addition, limited to no suitable topsoil is available from these areas (Exhibit 1; Exhibit T — Section 6.4.20(17); Sec- tion 6.4.5(2)(d)). If suitable topsoil is found in quantities greater than six inches, this topsoil will be removed and segregated from other run of mine rock. If such topsoil is not replaced on a backfill area within a time short enough to avoid deterioration of the topsoil, vegetative cover or other means will be employed so that the topsoil is preserved from wind and water erosion, remains free of contamination by toxic or acid - forming material, and is usable for reclamation. (2) Where practicable, woody vegetation present at the site will be removed from or appropriately incorporated into the existing topsoil prior to excavation within the affected areas. A reason- able effort will be made to ensure that existing vegetation is put to a beneficial use such as firewood, mulching, etc. (3) Topsoil stockpiles, if created, will be stored in places and configurations to minimize erosion and located in areas where disturbance by ongoing mining operations will be minimized. Any such stockpile areas will be included in the affected areas and subject to reclamation re- quirements. Immediate planting of an annual and/or perennial cover crop on topsoil stock- piles for the purpose of stabilization will be done if required by the Board. • May Day Idaho Mine Complex 112(d) Permit Application September 21, 2010 H.
