BASIN MD <br />APPLICANT <br /> APPROVED WELL LOCATION <br /> LA PLATA COUNTY <br /> NW 1/4 NW 1/4 Section 14 <br /> Township 36 N Range 9 W New Mex P.M: <br />DILLON RANCHES LLLP <br />PO BOX 1773 DISTANCES FROM SECTION LINES <br />DURANGO, CO 81302- 350 Ft. from North Section Line <br /> 550 Ft. from West Section Line <br /> UTM COORDINATES (Meters,Zone:13,NAD83) <br />(970) 247-9331 Poetinn• Nnrthinn- <br />ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT Page 1 of 2 <br />CONDITIONS OF APPROVAL <br />1) This well (hereinafter "gravel pit pond") shall be used in such a way as to cause no material injury to existing water rights. <br />The issuance of this permit does not assure the applicant that no injury will occur to another vested water right or preclude <br />another owner of a vested water right from seeking relief in a civil court action. <br />2) The construction of this gravel pit pond shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, <br />unless approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump <br />Installation Contractors in accordance with Rule 18. <br />3) Approved pursuant to CRS 37-90-137 (2) and (11) for the construction and operation of a gravel pit pond exposing and <br />diverting ground water tributary to the Animas River at a point where water is available for appropriation. This gravel pit is <br />known as the Sandco Inc. pit, Division of Minerals and Geology permit no. M-1987-064. <br />4) Approved for the expanded use of an existing well constructed under permit no. 59213-F. Permit No. 59213-F has been <br />canceled by order of the State Engineer. <br />5) The approval of this permit does not grant a water right. This gravel pit pond is subject to administration by the Division <br />Engineer in accordance with applicable decrees, statutes, rules and regulations. <br />6) The maximum pumping rate shall not exceed 350 GPM both during gravel mining operations and after gravel mining <br />operations are completed. <br />7) The average annual amount of ground water to be appropriated shall not exceed 123 acre-feet during gravel mining <br />operations, and 101.5 acre-feet after gravel mining operations are completed. The total surface area of the proposed <br />ground water pond is limited to 44 acres. <br />8) During gravel mining operations the use of ground water is limited to the irrigation of not more than 44 acres, dust <br />suppression, and evaporation. Upon completion of gravel mining operations the use of ground water is limited to the <br />irrigation of not more than 4.2 acres around the perimeter of the pond, recreational, piscatorial, stock watering, wildlife <br />watering, aquatic life, fire prevention and evaporation. No other use of water is allowed unless a permit therefor is <br />approved. Water from this well shall not be used for human consumption without separate approval from the Board of <br />Examiners of Water Well Construction and Pump Installation Contractors. The legal description of the 44 acres of irrigation <br />is as follows: portions of the E 1/2 of the NE 1/4 of the NE 1/4 of Sec. 15, the NW 1/4 of the NW 1/4 of Sec. 14, and the SW <br />1/4 of the SW 1/4 of Sec. 11, all in Twp. 36 North, Rng. 9 West, N.M.P.M., more particularly described on Exhibit B, Maps I <br />and II. <br />9) The owner shall mark the gravel pit pond in a conspicuous place with well permit number(s) and court case number(s) as <br />appropriate.
