4. The operator did make the proper corrections to the Exhibit C - Pre-Mining & Mining Plan <br />Maps of Affected Land #4. Please note the maps have been labeled as where the disturbed area is, <br />where the stock piles, and overburden piles are on the map, and what the structures are on the <br />southern conversion boundary in Revised Exhibit C - Pre Mining Map dated 8-19-10. <br />5. This information should cover your concerns about #5. Please refer to the original application <br />Attachment #1 that the operator is including for you to refer to the present vegetation covering the <br />affected lands within the conversion area. <br />6. This information should cover all of your concerns about #6. Please note that the Phase 1 & <br />Phase 2 have been clearly marked and labeled with the proper acreage for each Phase. We have also <br />marked where the disturbed ground is located and labeled it also. We have labeled and marked what <br />the structures are on the map. These are pieces of equipment that we have setting in our bone yard. <br />Mountain Park Concrete, Inc. feels we have satisfied all of your concerns with Exhibit C - Pre-Mining & <br />Mining Plan Maps of Affected Land. <br />7. The operator will provide the proper permit for building this crossing when the time comes <br />that we need to construct this crossing. It will be a simple build with buying a culvert that is big enough <br />to meet all requirements of the permit we will be obtaining when needed. We are unable to provide <br />you with all of the dimensions at this time. We will not need this crossing constructed until we are in our <br />2nd phase. <br />There is no need for the operator to provide you with documentation for legal right to enter the <br />easement associated with the drainage because the operator already owns this property. <br />8. The operator has revised the Mining Plan Exhibit D for you to view. The operator will be using <br />a 3 to 1 slope on the east boundary line staying 10' foot away from property line. On the northern & <br />eastern property line the operator will be mining in 20' foot benches. Along the west boundary the <br />operator will be mining that property line to a 3 to 1 slope. The earthmoving methods the operator will <br />be using are front end loaders, a dozer, and a motor grader to do all of the earthmoving associated to <br />the permitted area of the Parshall pit. <br />9. The operator has added the size of each phase on the Revised Pre-Mining Map Exhibit C. You <br />will see that each phase is labeled by number of acres and clearly marked. <br />10. The operator will commit to seeding topsoil stockpiles which remain in place longer than <br />one growing season and seeding the stockpiles with 30 pounds of Western Wheatgrass per acre. Please <br />refer to the adequacy response letter from Tuttle Applegate, Inc. dated May 21, 1998. <br />The operator will commit to salvaging enough topsoil to cover 4 to 6 of topsoil which will be <br />about 16,000 cubic yards for the reclamation process. However we are not able to commit to salvaging <br />all of topsoil for reclamation. <br />The operator will commit to the approved topsoil stockpile stabilization method and timeframe. <br />11. The preferred method of seeding in Exhibit E and Exhibit L have been changed to match. We <br />have decided to go with the preferred broadcasting method. <br />12. The operator will commit to crimping 2 ton per acre of mulch as required by the original <br />NRCS letter dated May 12, 1997.
