Introduction <br />The following materials represent an application to amend Regular 112 Reclamation <br />Permit M-2201-085 by the addition of 41.2 acres to the permitted area of the 124th <br />Estates Sand and Gravel Mine. Land proposed for addition to the permitted area lies <br />immediately north of 1201h Avenue and immediately west of the Fulton Ditch near <br />Henderson, in Adams County. This land will be used for the recovery of sand and gravel <br />resources prior to its reclamation for water storage. <br />There are currently 34.3 acres within the permitted area covered by Permit No. M-2001- <br />085; and if this application to amend is successful, the total permitted acreage will <br />become 75.5 acres. Two, Limited Impact 110 permits (M-2002-107 and M-2002-113) <br />are also related to mining activity at the 124th Estates Sand and Gravel Mine, as these <br />permits apply to haul roads, which provide access to the originally permitted mining area, <br />from 124th and 120th Avenues, respectively. <br />The Applicant/Proposed Operator, submitting these materials, is the Adams County RV <br />Park, LLC dba the 124th Estates Partners (the Applicant), the business entity which is the <br />Operator of the originally permitted mine site. The majority of the land, subject of this <br />application, is owned by the 120th Estates Partners, LLP. The Applicant and Mr. Peter <br />Schibli are the partners which make up the limited liability partnership of the 120th <br />Estates Partners, LLP. Mr. Schibli is also a member of the limited liability company, the <br />Adams County RV Park, LLC. A small portion of the 41.2 acres proposed for addition to <br />the permitted area is owned by the Henderson Water Ski Club, LLC. <br />Concurrent with this application to amend Permit No. M-2001-085, the Applicant is <br />seeking a conditional use permit from Adams County to allow mining and reclamation <br />for water storage, as well as all other necessary permits and approvals from the <br />appropriate regulating entities. <br />The Division will note that the Mining Plan for this new acreage includes the <br />construction of a soil-bentonite slurry wall to isolate the area of the mine from <br />surrounding groundwater during mining. Following the recovery of sand and gravel <br />resources, a partial clay liner will also be constructed, so that the combination of slurry <br />wall and liner will allow a reclaimed use of the land for water storage.
