NEW ITEMS <br />50A. In the first sentence of Subsection 1.0 of Section 2.05.4(2)(e), there is reference to "the <br />amendment area", which is undefined. Please delete the entire clause "and the amendment area ", <br />and end the sentence with "New Horizon 2 area ". <br />Text changes made as requested. <br />50B. In Subsection 3.0, narrative in the second and third paragraphs indicates that the area of land to <br />be reclaimed to irrigated use is less than was originally irrigated due to reevaluation of water <br />availability. The narrative should note that the reduced acreage in irrigation also reflects WFC's <br />preference to reclaim most of the lands they own to the west of 2700 Road as dryland pasture <br />rather than irrigated pasture. <br />Narrative now notes that the change in post - mining land use also reflects WFC's <br />preference as a landowner to reclaim most of it's land to dryland pasture. <br />50C. In Section 3.0, narrative pertinent to land tracts described as Parcels 1, 2, and 3 make reference <br />to "original classification by Peabody as Irrigated Pasture". These parcels located north of BB <br />Road and west of 2700 Road were not included in the Peabody permit area or vegetation study <br />areas. Also, although the parcels were predominantly irrigated pastureland and irrigated pasture <br />hayland, they included smaller acreages of rangeland. Please update the narrative as warranted. <br />The narrative in subsection 3.0(1) has been corrected to remove the Peabody Coal <br />reference and correct the original land classifications. <br />50D. Regarding Tract 1 (the Benson West parcel) narrative, language in the final bullet point indicates <br />that grading of the entire site would be done so as to facilitate irrigation across the whole <br />property. Due to steep slopes on portions of the acreage, it would be more accurate to state that <br />site grading would allow for future irrigation across a major portion of the property (as explained <br />in the paragraph following the final bullet point). Please amend the bullet point language. <br />Bullet point language amended as requested. <br />Rule 2.05.5 Postminine Land Uses <br />51. A typographical error in Subsection 2.1 was corrected as requested. Resolved. <br />52. As requested, a reference to correspondence with landowners regarding postmining land uses <br />was inserted in Subsection 3.0. Resolved. <br />53. WFC provided the proposed irrigation plans in the letters to the landowners where irrigation is <br />proposed. Resolved. <br />53A NEW ITEM — The various letters to the landowners have been compiled in Attachment <br />2.05.4(2)(3) -8. An organized presentation of the letters would be both helpful and useful. The <br />Division requests that the letters be organized into two sections within this attachment: <br />• Lands east of 2700 Road (Stains, Moore, Benson, Goforth, San Miguel Power, Burbridge, <br />WFC and Richards); and <br />• Lands west of 2700 Road (Morgan, Lloyd, Benson and WFC). <br />Please create a table of contents for this attachment, which lists each letter individually, by <br />landowner, date and subject. <br />
