<br />WFC staff developed the following remaining documents in house with, in some cases, <br />assistance from appropriate consultants: <br />Section 2.03 Legal, Financial, Compliance and Related Information <br />Section 2.04.5 General Geology and Hydrology Description <br />Section 2.04.6 Geology Description <br />Section 2.04.7 Hydrology Description <br />Section 2.05.2 Operation Plan - Life of Mine Plan <br />Section 2.05.3 Operation Plan - Permit Area <br />Section 2.05.3(3) Mine facilities <br />Section 2.05.3(6)(a) Overburden Blasting <br />Section 2.05.4(2)(c) Backfilling and Grading <br />Section 2.05.6(3) Protection of Hydrologic Balance <br />Section 2.05.6(3)(b)(v) Hydrologic Reclamation Plan <br />The proposed NHN Mine permit area is primarily located within W1/2 of Section 25 in <br />T47N, R16W. However it also includes a narrow strip of land in Section 36 of T47N, <br />R16W between the existing NH2 Mine and the proposed NHN Mine to be used to travel <br />heavy equipment from the NH2 Mine to NHN Mine after the completion of mining in <br />NH2 Mine. WFC expects this to happen some time in mid-2013. WFC plans to reclaim <br />this equipment corridor once the heavy equipment move to NHN North Mine is <br />complete. <br />Please note that part of the proposed NHN mining permit area includes the existing <br />mining permit area for NH1 Mine under Permit No.C-81-008. WFC requests that the <br />existing NH1 permit area be removed from the mine permit C-81-008 and included in <br />the proposed NHN Mine permit area. All bonding obligations associated with NH1 Mine <br />should also be included with the bonding obligation for the proposed NHN Mine and <br />reduced from the existing bonding obligation for Permit C-81-008. <br />In conjunction with this mine permit application WFC is also working to obtain the <br />following permits from other governmental agencies: <br />Special Use Permit from Montrose County <br />Air Emission Permit from Colorado Department of Health <br />Water Discharge Permit (NPDES) from Colorado Department of Health <br />Storm water Discharge Permit from Colorado Department of Health <br />404 Permit from Army Corps of Engineers <br />WFC will obtain other permits as required. <br />WFC plans to begin the mine development in Fall 2011 so the coal extraction could <br />begin in mid-2013. WFC requests DRMS to conduct an expedited review of the permit <br />application because of the time constraints.WFC will submit post-mining reclamation <br />bond as required by DRMS once the permit application is approved. <br />2
