4. The Applicant has stated no flow within the Arickaree River will be stopped, diverted, or <br />captured. During the inspection conducted on August 24, 2010, the Division observed <br />standing water within the current mining area. The Operator informed the Division the water <br />was from a precipitation event which occurred approximately one week prior to the <br />inspection. Please provide an explanation as to why the water had not drained away in a <br />week's time. In addition, explain how the Operator will avoid capturing water in the future. <br />The Applicant has stated grade control structures may be installed within the Arickaree River <br />on the west and east sides of County Road JJ. Please note that any grade control structures <br />which are installed must be within the permit boundary. County Road JJ was not included as <br />part of the permit boundary; therefore, any grade control structures placed on the east side of <br />County Road JJ would be outside of the permit boundary. In addition, all grade control <br />structures must be bonded for and approved by the Division prior to installation. If a grade <br />control structure is not approved during the permit review process, then the Applicant will <br />need to submit a Technical Revision to the permit at a later date. <br />6. The Applicant has stated "mining at the south property boundary of the pit will be sloped <br />10:1 out to the full depth of the excavation". Please clarify if the l OH: IV slope will be <br />created within the bed of the Arickaree River or outside of the channel. In addition, please <br />explain how creating a I OH:1 V slope will minimize downcutting of the Arickaree River. <br />6.4.7 Exhibit G - Water Information <br />7. The Applicant has stated the Operator will "attempt to keep stockpiles outside of the flow <br />area". Product stockpiles located within the Arickaree River could lead to increased turbidity <br />of the water when the river is flowing. The Division requests the Applicant commit to <br />keeping all stockpiles outside of the Arickaree River to prevent pollution of the water. <br />8. The Applicant has stated water flow would be able to pass through the site. Please clarify if <br />you are referring to water flowing through the portion of the mine site that is located within <br />the Arickaree River or through the portion of the mine site that lies outside of the Arickaree <br />River. Please note that storm water shall be contained within the site for all areas that lie <br />outside of the Arickaree River. If storm water will be exiting these areas, then the Applicant <br />will need to apply for a storm water discharge permit from the Colorado Department of <br />Public, Health and Environment. <br />6.4.6 Exhibit F - Reclamation Plan <br />9.
