Stormwater Inspection Report <br />Permittee: Wildcat Mining Corporation Cert. No.: None Date: 06/30/2010 <br />Facility: Idaho Mine and May Day Mine and Mill Industrial Type: Construction Receiving Water: Little Deadwood Gulch <br />site and La Plata River <br />Facility Address: North and north-west of unincorporated Mayday village, La Plata County, Colorado <br />Persons present: Mike Clements (Wildcat Mining Corporation - Owner); Ginny King and George Robinson (R Incorporated); Wally <br />Erickson and Steve Shuey (Division of Reclamation, Mining and Safety); Andrew Neuhart, Kathy Rosow and Erin Scott (CDPHE - <br />WQCD). <br />Facility Representative(s)/Title(s): Mike Clements (Owner) Inspector(s): Kathy Rosow CDPHE (WQCD) <br />Inspection Findings <br />The Water Quality Control Division (Division) inspector held a closing conference at the conclusion of the inspection. During <br />the closing conference, the inspector reviewed the inspection findings with the person present (Ms. Ginny King-R2 <br />Incorporated) and communicated the Division's expectation that all findings be corrected. <br />Note a: The construction activities described in this inspection report are part of "a common plan of development or sale", <br />which is a contiguous area where multiple distinct, but related, construction activities take place on different times and <br />schedules and are subject to a consistent plan for long-term development. <br />Consistent with EPA guidance, "contiguous" is interpreted to mean construction activities located in close proximity to each <br />other (within '/4 mile). Construction activities are considered to be "related" if they share the same development plan, builder <br />or contractor, equipment, storage areas, etc. All areas of land disturbance associated with construction activities that are part <br />of a common plan of development or sale must be summed to determine the overall area that will be disturbed. The specific <br />areas disturbed by Wildcat Mining Corporations are described in the Site Inspection portion of the inspection report. <br />Note b: The San Juan Basin Health Department (SJBHD) conducted an inspection of the facility on November 3 and 4, 2008, <br />and documented site conditions for a portion of the construction activities described in this inspection report. In addition, the <br />Division of Reclamation, Mining and Safety (DRMS) documented site conditions for portions of the construction activities <br />described in this inspection report (inspection report dated June 3, 2010-Idaho Mill and Idaho Mine). Relevant observations <br />from these inspections are referenced in this inspection report and attached. <br />Further, maps providing information specific to Wildcat Mining Corporation operations were provided to the Division <br />inspector by RZ Incorporated during the inspection, or obtained from publically available materials submitted to DRMS by <br />Wildcat Mining Corporation. These materials are referred to within this inspection report and attached. <br />Note c: The Colorado Water Quality Control Act requirements pertinent to this inspection report do not pre-empt, supersede, <br />or infringe on the lawful requirements and authority of federal agencies, state agencies, municipalities, counties, drainage <br />districts and local agencies. <br />Records Review <br />1. It was noted during the inspection that Wildcat Mining Corporation had conducted several land disturbing activities <br />(construction activities) without construction stormwater discharge permit coverage. The specific areas disturbed by <br />Wildcat Mining Corporations, and approximate area disturbed, are documented in Finding 2 below. <br />As provided by Mr. Mike Clements (Wildcat Mining Corporation - Owner) during the inspection, land-disturbing <br />activities (road construction) began at the site in July 2008 with the construction of a new access road from County Road <br />124 to the existing Forest Service Road-this road provides access to Wildcat Mining Corporation's May Day Mine and <br />Mill Site facilities and the Idaho Mine facilities. The Division determined that the new access road construction activities <br />(see 2.a below) and the other land disturbing activities noted during the inspection (see 2.b and 2.c below) are part of "a <br />common plan of development or sale" as described in Note a.
