A guidance
document on the SWMP preparation has also been enclosed.
If Wildcat Mining Corporation fails to obtain required stormwater discharge permit coverage and
discharges stormwater from the site once construction activity has started, it is in violation of the
Colorado Water Quality Control Act and subject to enforcement action by the Division. The Colorado
Water Quality Control Act authorizes both civil and criminal penalties for willful non-compliance.
This Compliance Advisory is intended to advise Wildcat Mining Corporation of possible violations of the
Colorado Water Quality Control Act, and its implementing regulations and permits, so that it may take
appropriate steps to avoid or mitigate formal enforcement action. This Compliance Advisory does not
constitute a Notice of Violation or Cease and Desist Order and is not subject to appeal. However, the
issuance of this Compliance Advisory does not limit or preclude the Division from pursuing its
enforcement options. The Division is currently evaluating the facts and if a formal enforcement action is
deemed necessary, Wildcat Mining Corporation may be issued a Notice of Violation / Cease and Desist
Order that may include the assessment of penalties.
If you have any questions, please call me at (303) 692-3521.
Sincerely,
Kathleen Rosow
Environmental Protection Specialist
Groundwater, Land Application, and Industrial General Permits Unit
WATER QUALITY CONTROL DIVISION
Enclosures (Application and SWMP guidance)
File Copy (T file: T-10-009)
Cc: Aaron Urdiales, EPA Region 8
Local Health Department
Steve Shuey, Division of Reclamation, Mining and Safety (electronic)
Wallace Erickson, Division of Reclamation, Mining and Safety (electronic)
Cindy Hockelberg, U.S. Forest Service (electronic)
File Copy
