.* <br />DRMS Mine Permit <br />• DP Spring and PR Spring were monitored for flow and PR Spring and the mine sump <br />were sampled in accordance with the established schedule. The results were reported <br />quarterly to DRMS. <br />• Groundwater was monitored on a bi-monthly basis from October 2008 through April <br />2010 to establish baseline conditions. Annual sampling of the well began in June 2010. <br />These activities and sample results were reported quarterly to DRMS. <br />Surface and Stormwater Discharge Permits <br />The water treatment plant ran intermittently as needed (approximately 100,000 gallons <br />per month) and discharge sampling was conducted in accordance with the permit <br />conditions and reported monthly to the Water Quality Control Division (WQCD) until <br />December 2009 when water treatment and discharge was temporarily suspended. <br />Stormwa.ter inspections were conducted on a monthly basis and reported to WQCD in <br />annual st:ormwater reports. <br />Conditional Water Rights Ruling <br />• Water Usage from the Mine was calculated on monthly basis and reported to Colorado <br />Division of Water Resources (DWR) and copied to DRMS annually. <br />Air Emissions Permits <br />• Three air emissions permits received final approval from the Air Pollution Control <br />Division (APCD) between March 31 and April 9, 2010. <br />• Estimated air emissions are calculated on a monthly basis and are reported to APCD upon <br />request. <br />Spill Prevention Control and Countermeasure (SPCC) Plan <br />• The Above Ground Storage Tanks (ASTs) on-site are inspected monthly. <br />Radon Monitoring <br />• An "Application for Approval of Construction" was submitted to the U.S. Environmental <br />Protection Agency (EPA) and copied to DRMS in August 2010. It will be followed up <br />during operations with radon monitoring and annual modeling to be submitted to U.S. <br />EPA. <br />Energy Fuels plans to reopen the Whirlwind Mine when uranium and vanadium market <br />conditions improve.
