May Concern, <br />This letter serves as the annual report for the Whirlwind Mine, DRMS Permit No. M- <br />2007-044. A check for the annual fee in the amount of $1,150.00 was sent to your office <br />on August 25, 2010. Per Mary Rodriguez at DRMS, it is our understanding that this <br />check has been received and credited to our account. Attached with this letter is the <br />Annual Report Request Form and a map of the current site layout. The Whirlwind Mine <br />is currently operating in intermittent status. This was established with the Substitute for <br />Notice of Temporary Cessation, sent to your office on May 12, 2009 and approved with the <br />June 5, 2009 letter issued by DRMS. The total disturbance at the Whirlwind Mine site <br />stands at 12.03 acres, as reported in the previous annual report. <br />No new surface disturbance has occurred at the Whirlwind Mine site since the last annual <br />report sent to DRMS on September 8, 2009. During this period, maintenance activities, <br />such as noxious weed management, stormwater control maintenance and reseeding, have <br />been performed on the surface facilities. Mine water removal, treatment and discharge was <br />suspended as of December 2009 and mine water is being allowed to accumulate in the <br />mine workings. During the period of intermittent status, the mine has been maintained <br />with periodic site visits. Vegetation has been well established on the periphery areas of the <br />original surface disturbance areas, the fill and topsoil stockpiles, and the diversion <br />ditches. Temporary vegetation is moderately established in the waste rock expansion <br />area, although this area is not required to be vegetated at this time. <br />Energy Fuels has remained diligent in meeting environmental compliance requirements set <br />forth in various permits and approvals required for the mine. A list of the various permits <br />and approvals and a brief summary of Energy Fuels' efforts to remain in compliance with <br />them follows. <br />Mesa County Conditional Use Permit <br />Bi-annual weed surveys and pesticide application were performed at the mine and along <br />5110 Road and were reported to Mesa County and the BLM. <br />Monthly monitoring and an annual precise survey of sediment pond posts (to detect <br />ground subsidence) were performed. No subsidence was detected.
