Pineda <br />2352 N 7" Street, Unit B Director <br />Grand Junction, CO 1 501 -1 <br />Re: Fruita Loadout (Pernlit No. C- 2010 -088) <br />New Application <br />Dear Mr. Stover: <br />The Division of Reclamation,, MMM9 and Safety (Division) has received your new permit <br />application to conduct coal in Colorado for CAM -- Colorado's proposed Fruita Loadout. <br />The application, submitted by CAM- Colorado LLC CAM- Colorado) was received on August 27, <br />2010. Our initial review indicates that all preliminary items required by Rules 2.03, 2.05, and 2.10 <br />have not been submitted. Thus, your application is incomplete for the purposes of filing as of <br />September ', 2010. <br />The following materials and infor nation are required for completeness. <br />l . Rules 2.03.6 1 ) Right of Entry and Operation Information, 2.05.3 (3) line facilities <br />including road specifications, and 2.10.3 Specific Information Requirements - <br />Access to the proposed Fruita Loadout site is not decried in the permit appliation nor is it <br />shown on any of the maps submitted with the application. How CAM- Colorado proposes <br />to gain access to the site is required information that has not been provided. without the <br />access being clearly identified, the Division cannot determine completeness or adequacy of <br />the application. .Access would have to be gained via a haul road since coal will be <br />transported to the site by haul truck. There appears to be two viable options for entering the <br />permit area from a public road, these would he off of State Highway 6 & 50 or from County <br />Road 15. Access from County Road 15 would require crossing the inactive Gilsonite <br />Refinery on private land located to the cast of the peiTnit area and the legal right to enter <br />documentation would need to be provided. Further, a "Haul Road" is not a public road and <br />would be required to he located within the permit area and design specifications would have <br />to be provided in the permit application to comply with Rule 2.05.3(3)(c). <br />Rule 2.10.3 1 (b) Specific Infonnation Requirements requires that the permit application <br />include naps showing the boundaries of land within the proposed permit area upon which <br />the applicant has the legal right to enter and begin surface or underground mining activities. <br />Office of <br />Office of <br />Mined Land Reclamation Deaver 9 Grand Junction • Durango Active and Inactive Mines <br />
