(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1984-013 <br />INSPECTION DATE: 97 h ly 2010 INSPECTOR'S INITIALS: DR2_ <br />OBSERVATIONS <br />This was a routine inspection conducted by David Bird of DRMS. The operator, George Otten, was contacted but <br />did not attend. The Mackey Mine is located 6 miles northwest of Blackhawk and is accessed by travelling <br />northwest about 2 miles up Hwy 119 from Blackhawk, turning left on Apex Valley Road, and then left on Forest <br />road 4 for about a mile. <br />The Mackey Mine is a 110(2) hard rock underground mine permitted for a total surface disturbance of 0.35 acres. <br />The Division holds financial warranty in the amount of $1,000, and the post-mining land use is listed as forestry. <br />The reclamation plan specifies backfilling of any waste rock generated during this operation into the underground <br />workings, securing of the mine portal, finish grading of the surface facilities, and reseeding of areas disturbed by <br />the operation. <br />Nobody was on site at the time of the inspection, and there was no evidence that there had been activity this <br />season. Annual reports filed by the operator document no activity for many years, possibly as far back as 1991. <br />The site is suffering from neglect with trash strewn about; equipment on site is in a state of disrepair and has <br />suffered significant damage, possibly from vandalism. <br />Several problems were noted during the inspection. First and of greatest concern, the adit portal was open and <br />accessible to public entry at the time of the inspection. This is a safety hazard and the operator needs to safeguard <br />the portal from public entry as soon as possible, but by no means later than 60 days from the date of this report. <br />Noncompliance with this corrective action will result in a violation and could result in the Division exercising <br />Specific Response Authority under Rule 8.5 (a). <br />The refuse problem already mentioned is a potential violation of §34-32-116(7)(d) C.R.S. Another problem relates <br />to signage and markers, and has been cited in previous inspections. The operator is required to post a sign and <br />boundary markers in accordance with Rule 3.1.12. <br />The amount of financial warranty held by the Division for the Mackey Mine is inadequate. The cost of cleanup, <br />demolition, and disposal at the site is estimated to exceed $3,300. With regard to safeguarding the mine opening, <br />standard DRMS guidelines for this activity specify a range of $50 to $60 per square foot of opening. Therefore the <br />cost of safeguarding the adit, assuming the cross-sectional area of the opening is around 60 square feet, would fall <br />in the range of $3,000 to $3,600. The sum of these two reclamation tasks plus indirect costs equals a new <br />required financial warranty of $8,162. <br />Finally, Annual Reports filed by the operator indicate that there has been no activity at the site for several years. If <br />there is no activity at the site, the operator must file for Temporary Cessation.
