PERMIT #: M-2003-058 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: August 18, 2010 <br />The policy states: <br />The Division will no longer allow the same applicant to permit side-by-side 110 Limited Impact mining <br />operations. Nor will the Division approve a Succession of Operator request to a 110 Limited Impact operation <br />where the approval will result in two or more side-by-side 110 Limited Impact operations held by the same <br />permittee. The bases for the denial are sections 34-32-110(2)(a) and 34-32.5-110(1)(a). <br />A copy of the Policy Memo is attached for reference. <br />Prior to Sessions submitting the application for File No. M-2010-039, Division staff discussed the options for <br />repermitting the Fairbanks II Pit from Lafarge West, Inc. The options were to convert the Fairbanks Pit, File <br />No. M-2003-058, to a 112 permit and include the Fairbanks II Pit area into the Fairbanks Pit permit or permit <br />over the Lafarge 111 permit with a new 110 permit. The applicant elected to permit over the existing 111 <br />permit issued to Lafarge, which Division staff now realizes is not allowed by the Division's policy. <br />Due to the Division policy mentioned above, the fact the Lafarge permit area will need to be expanded to <br />incorporate the disturbance outside of the permitted area (see the Fairbanks II inspection report), the current <br />disturbance in the 7 acre Pre-Law site and the continuing use of the Pre-Law site for equipment storage, <br />stormwater retention and as access to the Fairbank and Fairbanks II pits the Applicant must include all disturbed <br />areas into a 110 to 112 conversion application for the Fairbanks Pit. The Applicant must withdraw the 110 <br />application currently under review for the Fairbanks II Pit.
