PERMIT #: M-2003-058 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: August 18, 2010 <br />OBSERVATIONS <br />The Fairbanks Pit, File No. M-2003-058, was inspected by Peter Hays and Tony Waldron with the Division of <br />Reclamation, Mining and Safety (Division) in conjunction with an inspection of the adjoining Fairbanks II site. <br />A representative from Glenn E. Sessions & Sons, Inc. was not at the site during the inspection. This inspection <br />is a follow-up inspection to the July 19, 2010 inspection to verify the problems cited during the previous <br />inspection have been corrected by the Operator. <br />Please contact me at (303) 866-3567 Ext. 8124 with any questions. <br />7/19/2010 Observation: <br />A Pre-Law 7 acre mine site exists northwest of the permitted site. It appears the Pre-Law area was used as an <br />asphalt batch plant site by Lafarge West, Inc as part of the Fairbanks II pit. Per Rule 6.3.5(2)(f), redisturbance <br />of previously disturbed areas, by the mining operation, must be included in the permit area. Lafarge left <br />stockpiled material in the Pre-Law area. The Division does not consider the remaining stockpiles left by <br />Lafarge to be a problem or possible violation at this time. However, Glenn E. Sessions must remove the new <br />stockpiles from the Pre-Law site and not redisturb the area as part of the mining operations at the Fairbanks or <br />Fairbanks II site. Redistrubance of the Pre-Law site would require the Operator to include the area in the <br />reclamation permit for the Fairbanks Pit. <br />Follow-up Observation: <br />The Lafarge stockpile located in the northeast corner of the Pre-Law area has been moved by Session to the <br />Fairbanks site. However, two stockpiles of material remain west of the entrance gate and along the south side <br />of the Pre-Law area, equipment was stored in the area, and the survey results indicate the Pre-Law area is used <br />as access to the Fairbanks and Fairbanks II sites. <br />7/19/2010 Observation: <br />The boundary markers could not be located during the last inspection. This was cited as a problem and required <br />corrective action by the Operator by a corrective action date. <br />Follow-up Observation: <br />The boundary markers have been marked and were indicated by survey pins and wood stakes with flagging. <br />This problem has been resolved by the Applicant. <br />7/19/2010 Observation: <br />The pit floor contained water during the last inspection. Mr. Brocker stated the source-of-the-water-was <br />irrigation ditch adjacent to Highway 14. The ditch flow was expected to end soon. The Operator had <br />constructed shallow ditches to direct the water towards the northwest to a pond in the Pre-Law area. No <br />discharge to the Michigan River was noted during the inspection. Mr. Brocker stated the water from the pond <br />would be discharge to the river as allowed by the Storm Water Management Plan in the near future. <br />Follow-up Observation: <br />The pit floor contained less water than previously observed. The water appeared to be seeping into the gravel <br />floor. No flow of water was observed during the inspection, the shallow ditches were dry, and the pond in the <br />Pre-Law area was dry. This problem has been resolved by the Operator. <br />Tony Waldron the East Team Minerals Supervisor mentioned during the inspection, the Division has a <br />policy preventing side-by-side 110 Limited Impact mining operations. <br />Page 2 of 3
