As indicated in the Plan, the District will comply with State law and obtain a well permit from the SEO pursuant to 37-90-
137(11) and replace out-of-priority depletions from exposed groundwater (to create wetlands) in the La Plata River with a
water-court approved augmentation plan. A short- and long-term monitoring program with annual reporting requirements
is detailed in the Plan to ensure reclamation success. Furthermore, the District has the financial capacity to implement
the Plan (attached) and permission to use the site from the landowner. The operator of the existing State 112 Permit
(Skanska USA) is amenable to the Plan if the CDRMS authorizes the change in use.
The purpose of this email is to solicit a response from your office indicating that the terms of the 404 Permit and proposed
Plan meet and/or exceed the Reclamation Performance Standards identified in the Mineral Rules and Regulations and
that the Department of Army has the regulatory authority to ensure reclamation is completed in accordance to the Plan,
thereby satisfying the reclamation statute of the CDRMS.
If you have any questions please call.
Thanks,
Ryan
Ryan Unterreiner
Bikis Water Consultants, LLC
555 RiverGate Lane, Suite 134-82
Durango, CO 81301
(970) 385-2340 ph (970)385-2341 fax
ryanabikiswater.com
www.BikisWater.com
This message may contain confidential and/or privileged information.
