As an active sand and gravel pit, the Colorado Division of Reclamation, Mining & Safety <br />(CDRMS) is required by statute to ensure that any disruption of land within the permitted area is reclaimed (Mineral Rules <br />and Regulations of the Colorado Mined Land Reclamation Board for the Extraction of Construction Materials - October, <br />1995, Amended August 2006). That is, reclamation of disrupted areas must provide for the establishment of plant cover, <br />stabilization of soil, the protection of water resources, or other measures appropriate to the subsequent beneficial use of <br />such affected lands as described in the State 112 Permit. <br />According to the attached Final Mitigation Plan (Plan) provided to your office by the 404 permittee (La Plata Water <br />Conservancy District) (District), approximately 7 acres of land within the existing 112 permit would be temporarily <br />disrupted as a result of the Plan. Disrupted lands primarily include the wetland creation area and soil disposal area <br />indicated on Figure 3. The Plan includes details on the existing conditions (Figure 2), proposed final condition (Figures 3 <br />and 4) and proposed monitoring (Figure 5) to ensure the success of the Plan. Special Conditions 7, 8 and 9 of the 404 <br />Permit respectively require the permittee to notify your office when the Plan is complete, submittal of as-built plans after <br />construction and on-going monitoring to ensure the proposed project has not caused degradation to water quality. <br />According to the 404 permit, the Department of Army has regulatory authority to enforce compliance of the Plan, as <br />described in 33 CFR 326.4 and 326.5.
