Use of road base materials from Ruby Trust Mine <br />Dear Mr. Emmett: <br />Ouray County is willing to accept and use certain road base materials (waste rock) from <br />the Ruby Trust mine under the following conditions: <br />1. Material will be acquired and used by Ouray County, generally in the <br />spring and fall months when labor, equipment and road conditions permit and such <br />material will be incorporated into Ouray County roads. Ouray County will work <br />cooperatively with the Ruby Trust mine to remove the material at such times that <br />representatives of the Ruby Trust mine have contacted the Ouray County Road and <br />Bridge Superintendent to advise that the stockpile of material is reaching the maximum <br />allowed by the mine's permit(s). <br />2. We are in receipt of a "solids analysis acid : base accounting" report <br />regarding the material that is currently stockpiled at the site. We will accept material <br />from the Ruby Trust mine that is in conformance with such analysis, however, if the type <br />of material changes or it is suspected that the material may contain some type of <br />hazardous material, we will require a new analysis of the material and will cease <br />acquiring the product until such analysis is received.
