14. The Applicant states, the site will be revegetated with pubescent wheat grass at a rate of 28 pounds <br />per acre. The Operator committed to using a diverse six seed mixture at 30 pounds per acre during <br />the 110c adequacy review. Please reference the adequacy response letter from Tuttle Applegate, <br />Inc. dated May 21, 1998 and commit to using the approved six seed mixture and application rate <br />for reclamation. <br />15. The Division recommends the Operator review the current reclamation plan for the Parshall Pit <br />110c permit to ensure compliance with the approved permit. The permit documents are available <br />on the Division's website, http://mining.state.co.usiimagedDocuments.htm. The Operator is <br />encouraged to contact the Division with questions. <br />6.4.7 Exhibit G - Water Information <br />16. Please provide the Division a copy of the changed water right for the Dawson Gulch Spring from <br />livestock to commercial use. <br />6.4.12 Exhibit L - Reclamation Costs <br />17. The Division prepared a reclamation cost estimate for the Parshall Pit. The estimate was based on <br />a phased mining operation, where only 22 acres will be affected at any given time. The Division <br />estimates the total cost to reclaim the site is $133,000.00. A copy of the estimate is enclosed for <br />review. <br />6.4.13 Exhibit M - Other Permits and Licenses <br />18. Please commit to supplying a copy of all other permits and licenses to the Division, including but <br />not limited to; Grand County Conditional Use Permit, Colorado Air Pollution Control Division Air <br />Pollution Emission Notice (APEN), and Colorado Department of Public Health and Environment <br />Storm Water Permit. <br />6.4.14 Exhibit N - Source of Legal Right to Enter <br />19. The source of the Applicant's legal right to enter and initiate a mining operation on the affected <br />land does not meet the requirement of Rule 6.3.7. Please provide the Division a signed statement <br />by the Landowner and acknowledged by a Notary Public stating the Operator/Applicant has legal <br />right to enter the mine or other approved basis for legal right of entry to the site and to conduct <br />mining and reclamation. <br />6.4.17 Exhibit Q - Proof of Mailing Notices to Soil Conservation District <br />20. Please note the Proof of Notice to Soil Conservation District is mislabeled Exhibit R instead of Exhibit <br />Q. <br />6.4.18 Exhibit R - Proof of Filing with County Clerk and Recorder <br />21. Please note the Proof of Filing with County Clerk and Recorder is mislabeled Exhibit S instead of <br />Exhibit R. <br />6.4.19 Exhibit S - Permanent Man-made Structures <br />22. Please note the Permanent Man-made Structures exhibit is mislabeled Exhibit T instead of Exhibit S.
