10. The Mining Plan states the site will be mined to a depth of 25 feet. The Final Contour Plan <br />Map shows the center of the Arikaree River is 45 feet below the existing grade. Please <br />confirm if the bed of the Arikaree River will mined 45 feet below the existing grade. <br />11. The Applicant has stated the mine site may be unworkable for a few days when rainfall <br />occurs. Please be aware that if stormwater runoff is intercepted by this operation and is not <br />diverted or captured in priority, it must be released to the stream system within 72 hours. <br />12. Excavations created within ephemeral washes can lead to channel downcutting upstream and <br />downstream of the excavation area. Please describe how County Road JJ will be protected <br />from potential impacts of downcutting. The Operator may consider installing grade control <br />structures upstream of the excavation area to mitigate the impacts of downcutting. The <br />Operator may also limit extraction to the annual bedload yield of the Arikaree River. <br />6.4.5 Exhibit E - Reclamation Plan <br />13. The Reclamation Plan calls for planting a cover crop. However, the Seeding Plan provided <br />by the Natural Resources Conservation Service (MRCS) does not include a cover crop. Please <br />confirm if a cover crop will be used. If so, specify the type of cover crop and the application <br />rate (# PLS/acre). <br />14. The Applicant has indicated in Exhibit L the slopes will be fertilized with fertilizer or <br />barnyard manure. However, the Seeding Plan provided NRCS does not contain a <br />recommendation for using fertilizer. Please confirm if fertilizer will be applied to the <br />disturbed area prior to seeding. If fertilizer will be used, please specify the type and the <br />application rate. <br />6.4.6 Exhibit F - Reclamation Plan Map <br />No comment. <br />6.4.7 Exhibit G - Water Information <br />15. The Applicant has stated stormwater will be contained in all areas except Phases 1 and 2. <br />Please describe how stormwater will be managed in Phases 1 and 2, including a description <br />of how the stockpiles will be protected. <br />16. The applicant has stated berms will be used to contain stormwater runoff in the pit. Please <br />provide the division with the dimensions of the berm, this information is required to <br />complete the financial warranty calculation. <br />6.4.8 Exhibit H - Wildlife Information <br />No comment.
