In that, report you said the that the <br />permit covers 48 acres approximately and of that 40 could be affected." However the operators <br />has calculated 25.05 acres of affect lands. The operator reported 23.6 acres to the Division of <br />Reclamation, Mining and Safety in their annual report that is close to the new figure that this <br />technical revision will be based upon. The next item of concern was that of the highwall being <br />limited to the 1570 lineal feet as the original permit reflects. The operator would like to revise the <br />length of highwall to a number that would be more to a number that would give them a range in <br />which to work with the current length of all the highwalls is 1590 lineal feet. Since the operator is <br />abandoning the phased mining and is concurrently mining the rock with the clay resource it <br />would it would be advantages to have a margin of 25 % added to the 1570 lineal feet limit. This <br />would help the overall mining plan by allowing the operator to strip and process more cap rock <br />for processing which has a salable market that is increasing due to contractual agreements. The <br />operator would also recommend that the highwall height limit of 22 feet be adjusted to a <br />maximum of 45 feet with a reclamation slope range of 30° to 35° from vertical to meet the <br />original Division of Reclamation, Mining and Safety Stipulation No. 01 of 22 feet. The operator <br />feels that with careful blasting techniques this can be achieved and that during the active mining <br />of the face a steeper slope can safely be maintained. The rational for this is that the highwalls are <br />stable during excavation and can be safely worked even after blasting. The mine history is that <br />the highwalls are stable. <br />The operator has included in this technical revision a map marked Sheet 5 of 6 dated August 6, <br />2010 to show the existing Permit Boundary as it exist presently overlay onto one of the original <br />maps dated July 10, 1977. The operator assumes that this map is what the Mined Land Board of <br />Reclamation and the Division of Reclamation, Mining and Safety approved when this mine site <br />was put into effect when the ACTwas passed. The operator does understands that this pit was <br />modified since that time however this should show a representation of pre-law mining. The <br />operator has set monuments to delineate the existing configuration.
