Scott, Eric <br />From: Scott, Eric <br />Sent: Tuesday, August 10, 2010 1:06 PM <br />To: hempef@ci.loveland.co.us <br />Cc: Dan Giroux <br />Subject: Kauffman Technical Revision TR02 <br />Mr. Hempen, <br />I have reviewed the letter dated Aug, 5 2010 regarding the construction, monitoring and testing of the roadway <br />(Boyd Lake Avenue Extension) to be built through the Kauffman Pit (M1999-069). This will satisfy our <br />requirement for construction specification and QA/QC testing documentation. The City's acceptance of the <br />work completed will be construed by the Division to mean that all applicable requirements have been met. <br />The Division would like to make clear at this time that because the City of Loveland has acknowledged that it is <br />the responsible party for the construction of this roadbed feature, and because DBMS does not bond other <br />government entities, DRMS will not be bonding the permittee for the construction of this road bed as part of the <br />overall site reclamation bond. If for some reason this site would go into forfeiture before the roadbed is <br />constructed, or during construction, DBMS will NOT be responsible for the construction or completion of this <br />roadbed.
