Wagner/Kauffman Pit #3, M-1999-069, v' <br />Larimer County, Colorado <br />Dear Mr. Scott: 4 <br />The City of Loveland hereby asserts that it is the party responsible for the construction of the <br />roadway embankment required for the future Boyd Lake Avenue Extension relating to the <br />Wagner/Kauffman Pit #3 reclamation. The proposed roadway embankment design is <br />represented to schematic detail on the Technical Revision (TR) exhibits we have reviewed, as <br />submitted to the Division last month. <br />The roadway embankment construction will be performed using materials from the <br />Wagner/Kauffman Pit #3, and will be based on analysis, design, plans and specifications <br />developed directly by the City of Loveland, or under the City's specific direction. In addition, the <br />City will be monitoring and testing the construction of the roadway embankment fill through a <br />construction management company, to ensure compliance with the plans and specifications. <br />Respectfully, <br />Frank B.
