(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1975-009 <br />INSPECTION DATE: 22 1111y 2010 INSPECTOR'S INITIALS: _DR? <br />OBSERVATIONS <br />This was a routine inspection conducted by David Bird of DRMS along with Steve O'Brian of Environment, Inc. <br />representing the operator. The site is located about one mile north of the intersection of Plainview Road and <br />Colorado Highway 72 on the east flank of the foothills. Clay is the only commodity produced at the site. The <br />total permit area is 5.0 acres, and the Division holds financial warranty in the amount of $5,000 for the operation. <br />The post-mining land use is described as rangeland. <br />The 5 acres of permitted ground is divided into three separate areas. However, Mr. O'Brian indicated that the two <br />northernmost sites have not been disturbed since the current operator acquired the permit in the early 1980's, <br />which observations on the ground confirmed. The southernmost site sees yearly activity, with annual production <br />ranging from about 3,000 to 8,000 yards or product. Mr. O'Brian reported that 2009 production was about 6,000 <br />yards. <br />There are three problems at the site needing attention. First, the entrance sign required under Rule 3.1.12(1) is <br />missing and must be replaced. Mr. O'Brian also noted that the permit boundary markers are difficult to accurately <br />locate. This issue should be rectified concurrently with replacement of the entrance sign. Second, the records on <br />file with the Division do not adequately depict the permitted area. This was cited as a problem during the last <br />inspection conducted 28 May 2004 and remains unresolved. The operator must submit an accurate map <br />depicting the correct permit boundary. Third, a recalculation of the reclamation costs indicates that the financial <br />warranty held by the Division for the site is inadequate. Additional financial warranty must be submitted to bring <br />the total amount held by the Division up to $8,385. The aforementioned problems are also listed on page 3 of <br />this report. <br />Mr. O'Brian noted that the operator may seek to modify the permit boundary by releasing the two northern, <br />inactive portions, and consolidating the 5.0 acre permit area around the active southern pit. This modification <br />would have to be submitted as a Technical Revision JR) to the permit. <br />Storm water runoff was cited as an issue in the 2004 inspection report. No runoff problems were observed during <br />this inspection despite recent heavy rains, but the operator is advised to monitor the situation and maintain <br />adequate controls to prevent runoff. <br />The reclamation plan for this site is pre-law and thus is abbreviated by modern standards. As no provision is made <br />for highwall reduction, the highwall in the southernmost pit will likely remain. Regrading will consist of <br />contouring to "blend with adjacent areas" as specified in the original reclamation plan.
