Demnber 31, 2007
Divasian of Reclamation, Muim& and Safety
1313 Sherman Street
Room 215
Denver, Colorado 80203

7r JAN 10 ZOUU
Dlvisian CA
Mining and Safety

lie: Technical revision to the New Horizon URne Permit No. C-81-008 , This Teftical
Revision is to Section 2.03.4(2)e. Ms is by Western F eWj&,Coloredo (WFC) in, Nucla, Co.
Detix Sire:

I ann w6ting this letter as a formal pretest to the application f¦a.a Technical Revision to the
New Hafton Mine Pemnit No. C-8I-MS. ALWOft renewal of their exit This
Technical Revision covers the Change in Success Standards in Irrigated Pastore f om a
standard to a refereance area.
I have lived in Nucla must of my life and I am a landowner in thearea affected by WFC. I stn
familiar with this area, the people wbo are landawam , and the agricultural ages of the land
in the area. Agrk lture has been a mainstay of this wea since Nucla become a haulm, and was,
in lhct, the reason d olmn of Nudla evolved in 1906. Land hrlhs me ho been and still is
utilized for crops suck as aifalfir, cons, wheat, and oats, etc. Some of the land is used as irrigated
paskircland, but this is usually the inferior land that is not as well suited for crop production.
Even crop land, once harvested, is pastured. This is not the primary use of the aontap and
should not be bow it is classified.
This is one reason, for my protest. The Morgan. property whet -is the property,
in.. quteation, is irrigated farmhand. Attar inspection of the revision, this
property along with. Hereon, Lloyds„ Johnson% etc. are all to be classified
as- DRYLAND. This is unhowd of Just prior to the take over of the Swnshine
Carter of Mor ns, We pumband 200 too, of pfte Alfalfa Hay. The Morgans
have alwaya.planted ,A?lfalt and thin Sunshine Place was some of the prettiest
fields in the country. These lands have always been irrigated crop lands with
very high yields-
I am objecting and would like to see all of this land in question put lack the
way it was or better prior to the leases. Feed is not overly plentiful in Nucla
and all of these prime farmlands should be put back as such, Thy land is
out of the question and ft re is water available to put these lands back.
Some of the Morgan, pnn r being mined has some of the best wpd "l
here-
Thank you,
