1tRestoration Task: Proposed Activity ' Justification. Division Response <br />-Muck out May Day To mitigate property damage Protect Wildcat Mining Not Approved at this time--This task <br />No. 1 risk shown in Mr. Erickson's Corporation capital equipment would require use of construction <br /> recent photographs, remove equipment not available at the site. No <br /> collapsed material in May Day legal access currently exists to <br /> No. 1 adit/portal and from the transport equipment to the site and the <br /> crushing and conveying unpermited access road cannot be used <br /> equipment to transport equipment to the site. If <br /> Wildcat is able to secure site access <br /> with the USFS for delivery and use of <br /> equipment, further discussion would be <br /> neccessary to determine the scope of <br /> work. If it is determined, after the <br /> discussion, that some muck out work is <br /> permitted the Division would require <br /> the submittal of a Technical Revision, <br /> including detailed specifications, to the <br /> Division for review and approval prior <br /> to the commenement of any work. Any <br /> muck out work would have to be <br /> coordinated with MSHA to ensure that <br /> the activities are conducted safely. <br />-Remove stored ore Material has been stored for 6 Interim measures to prevent Not Approved--Again, no legal access <br />from May Day No. 1 months movement of fine grained currently exists to transport equipment <br />and move off site.for material from the pile during the to the site and the unpermited access <br />processing permitting preparation and road cannot be used to transport <br /> review process equipment to the site. In addition, no <br /> production related activities can take <br /> place under a cease and desist. <br />-Stabilize portals per Prepare roof-stabilize with Protect Wildcat Mining Not Allowed at this time--The Division <br />MSHA requirements timbers or suitable material to Corporation capital equipment needs further details and clarification <br />including May Day strengthen entry-as necessary from Wildcat regarding this requested <br />No. 1 and 2 and Chief use shotcreke to stabilize and activity and the extent of the proposed <br /> strengthen entry plan. The Division anticipates an <br /> interim plan that would include <br /> minimal muck out of the No. 1 portal <br /> as well as adequate stabilization as <br /> required by MSHA in order to allow <br /> Wildcat enter the portal to obtain <br /> groundwater samples. However, <br /> minimal muck out and stabilization <br /> activities may not be sufficient for safe <br /> access. Also, the chief portal is outside <br /> the permit boundary and stability <br /> work cannot take place until it is <br /> properly permitted. <br />Restoration Page 2 of 3
