PERMIT #: M-1978-332 <br />INSPECTOR'S INITIALS: MAC <br />11VJrrlu I IUIN VA1 L: JU1V2/. 1U10 <br />INSPECTION TOPIC: Reclamation Success <br />PROBLEM/POSSIBLE VIOLATION: Problem: Failure to follow approved reclamation plan, or current reclamation plan needs to be <br />updated and clarified pursuant to C.R.S. 34-32.5-116 (1). The operator must follow approved reclamation plan or provide sufficient <br />information to describe or identify how the operator intends to conduct reclamation. <br />CORRECTIVE ACTIONS: The operator shall submit a Technical Revision, with the required $216 revision fee, to update and clarify <br />the current approved reclamation plan to reflect existing and proposed activities by the corrective action date. In addition to the updated <br />reclamation plan, the operator shall also submit engineering stability analyses for the excavation rooms, which demonstrate the stability <br />of the site both during and after mining. <br />CORRECTIVE ACTION DUE DATE: 8/31/10 <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety (Division). <br />Caleb Liesveld of Colorado Rose Red Corporation was also present for the inspection. The Colorado Rose Red Pit is <br />located 7 miles northwest of Lyons, Colorado. The site is permitted for one acre and the post-mining land use is <br />industrial/commercial. <br />(AR) Availability Of Records: <br />A review of the permit file found the Division does not have a record of a Reclamation Plan Map, this has been cited as a <br />problem and will require corrective action by the Operator. In addition, the Mining Plan Map does not clearly depict the <br />features associated with Mining Plan. A copy of the applicable sections of the Rules, which outline the requirements of <br />the Mining Plan and Reclamation Plan Maps, have been enclosed with this report. <br />(FN) Financial Warrant <br />The Division currently holds a financial warranty in the amount of $500.00, which is sufficient to complete reclamation <br />under the approved Reclamation Plan. However, the Mining Plan and Reclamation Plan must be updated to account for <br />the current disturbance at the site. Upon submittal of an updated Mining and Reclamation Plan, the Division will <br />reevaluate the amount of the financial warranty. Notice of any change to the financial warranty will be sent under separate <br />cover. <br />(MP) Gen. Compliance With Mine Plan: <br />The approved Mining Plan states the work deck will be lowered from its original elevation by removing blocks of granite. <br />During the inspection it was observed that the Operator is no longer lowering the deck, but is instead mining into the face <br />of the mountain. The Operator has created three separate rooms. The room adjacent to the west permit boundary is <br />approximately 14' high, 50' wide and 20' deep. The next room occurs immediately to the east of the westernmost room. <br />This room is approximately 14' high, 50' wide and 30' deep. The room on the east end of the permit boundary is <br />approximately 14' high, 50' high and 100' deep. According to the Operator, the wall between the middle room and east <br />room will be partially mined through to connect the two rooms. The Mining Plan does not address the creation of these <br />rooms; this has been cited as a problem and will require corrective action by the Operator. <br />The Colorado Rose Red Pit is permitted for one acre. Using a 2009 aerial photograph and field measurements, the current <br />disturbed area was determined to be 0.95 acres. A large waste rock pile was observed on the mountain face immediately <br />below the work deck, which is outside of the permit boundary. A review of the permit file found that the waste rock pile <br />was in existence prior to the issuance of a Reclamation Permit. As such, this area is not subject to reclamation. The 2009 <br />aerial photograph was compared against inspection photographs taken in 1985 and it appears the disturbance has not <br />changed in size. The Operator should be aware that all mine related disturbance, including waste rock piles, must occur <br />within the approved permit boundary. Therefore, no waste rock should be discarded over the edge of the work deck. <br />Placing waste rock outside of the permit boundary could result in a possible violation for failure to protect areas outside of <br />the affected land from slides or damage. In addition, the Operator should be aware that any increase to the disturbed <br />acreage will require an amendment to the permit. <br />Page 2 of 5
