OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Availability Of Records <br />PROBLEM/POSSIBLE VIOLATION: Problem: The Division does not have a record of a Reclamation Plan Map. Rule 6.3.5(1) of <br />the Construction Material Rules and Regulations requires the Operator to provide a copy of the Reclamation Plan Map that clearly <br />describes the features associated with the Reclamation Plan. <br />CORRECTIVE ACTIONS: The Operator shall submit one map for the Reclamation Plan. The map must be drawn to scale no smaller <br />than appropriate to clearly show all elements that are required to be delineated by the Act and the Rules; show a north arrow, note any <br />section corners adjacent to the operation, and indicate the date illustrated. At a minimum, the map must include the information outlined <br />in Rule 6.2.1(2) and 6.3.5(3). The map shall be submitted to the Division in the form of a Technical Revision along with a revision fee <br />of $216.00. The map shall be submitted to the Division on or before the corrective action date. <br />CORRECTIVE ACTION DUE DATE: 8/31/10 <br />INSPECTION TOPIC: Availability Of Records <br />PROBLEM/POSSIBLE VIOLATION: Problem: The Mining Plan Map has not been updated to reflect the changes in the Mining <br />Plan. Rule 6.3.5(1) states the Mining Plan Map must clearly describe the features associated with the mining plan. <br />CORRECTIVE ACTIONS: The Operator shall submit one map for the Mining Plan. The map must be drawn to scale no smaller than <br />appropriate to clearly show all elements that are required to be delineated by the Act and the Rules; show a north arrow, note any section <br />corners adjacent to the operation, and indicate the date illustrated. At a minimum, the map must include the information outlined in Rule <br />6.2.1(2) and 6.3.5(2). The map shall be submitted to the Division in the form of a Technical Revision-al ong-with a revision fee of <br />$216.00. The map shall be submitted to the Division on or before the corrective action date. <br />CORRECTIVE ACTION DUE DATE: 8/31/10 <br />INSPECTION TOPIC: Gen. Compliance With Mine Plan <br />PROBLEM/POSSIBLE VIOLATION: Problem: The current mine plan needs to be updated and clarified pursuant to C.R.S. 34-32.5- <br />112 (1)(c)(VI). The operator must provide sufficient information to describe or identify how the operator intends to conduct the <br />operation. <br />CORRECTIVE ACTIONS: The operator shall submit a Technical Revision, with the required $216 revision fee, to update and clarify <br />the current approved mine plan to reflect existing and proposed activities by the corrective action date. <br />CORRECTIVE ACTION DUE DATE: 8/31/10 <br />Page 1 of 5
