Mr. Penfield W. Tate, III
Page 2
August 2, 2010
• Engineering Stability Analysis-Evaluation of proposed final reclaimed slopes for
roads, portals and benches. This activity is only allowed if it is true field verification
and can be conducted without the use of equipment and involves no construction
activities.
• USACOE Permit-Annual monitoring of wetland mitigation. Again, this activity is
only allowable if it is true field verification and can be completed without the use of
heavy equipment.
In addition to the field verification activities that were discussed and approved, the
Division provided a preliminary approval of the "housekeeping tasks" outlined in Wildcat's
July 26th submittal. The tasks preliminarily approved include: Substances stored on pallets,
Drums of petroleum in secondary containment, Stained soil removal, Trash removal. At this
time, the Division does not authorize the relocation of the stockpiled ore as more information is
needed by the Division. Regarding the housekeeping tasks, the Division needs to know a work
schedule and when work on these tasks will commence.
In addition, upon commencement of the approved work the Division would like to
receive weekly updates regarding the status and progress of the work. Finally, please provide
the status of the possible limited access to the site via the USFS road and verify if a formal
written request has been submitted to the USFS.
Thank you again for the cooperation and please call if you have any questions.
Loretta Pineda
Director
Division of Reclamation, Mining and Safety
cc: David Berry - DRMS
Steve Shuey - DRMS Grand Junction Office
Wally Erickson -DRMS Durango Office
Jeff Fugate - Attorney for DRMS
