Pineda <br />Greenberg Traurig Director <br />E-mail: tatep@gtlaw.com <br />SENT VIA E-MAIL <br />RE: Confirmation of Phone Conversation Friday, July 30, 2010 - Preliminary Approval of <br />Requested Activities <br />Dear Mr. Tate: <br />This letter confirms our phone conversation on Friday, July 30, 2010, regarding <br />authorized activities at the May Day and Idaho Mine sites. As was discussed, the Division has <br />authorized some activities at the sites on a limited or preliminary basis. A more detailed letter <br />may follow that addresses the more specific requests submitted by Wildcat on July 26, 2010. <br />The activities authorized by the Division will be exceptions to the Board issued cease and desist <br />orders, therefore, the reminder of the cease and desists will remain in full force for both sites. <br />As we discussed, the Division will allow limited use of the unpermitted access road to <br />accommodate walk-in access only as needed to complete the field verification activities over the <br />next week. Please note, that this permission for use of the unpermitted road does not include <br />use of motorized vehicles or heavy equipment. It is my understanding from the conversation <br />that the field verification activities the Division has authorized is pre-permit application field <br />work that can be accomplished by foot with hand tools, and will have limited or no impact. The <br />Division is not authorizing more complex field verification that requires use of heavy <br />equipment. The field verification activities discussed and authorized by the Division on Friday <br />July 30 are: <br />¦ Soils Information-Collection of topsoil samples, and hand dig pits to determine <br />topsoil depths. <br />• Vegetation Information <br />• Ground Water Quality Data-Evaluate conditions of identified cistern and attempt <br />to locate permitted well No. 64335 and, if possible, obtain groundwater samples. <br />• Surface Water Quality Data-Collection of 2nd quarter of data from the four <br />identified collection locations. <br />¦ Plant Growth Medium-Site specific soils investigation and collection of <br />representative growth medium <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
