6.4.12 EXHIBIT L - Reclamation Costs 3.) The Division has calculated a financial warranty amount based on the proposed mining and reclamation plans, the project schedule submitted with the first-adequacy review response, the current level of disturbance based on the observations during the pre-operation inspection and the latest annual report map. As requested, the Division included the cost to construct a slurry wall around the current excavations using the 20% bonding option. For the embankment construction; based on the project sequence and schedule, the applicant intends to strip all the overburden necessary for the embankments all at once between September of this year and February of 2011 prior to the construction of the embankments. Given this, the Division must hold a bond to replace all the overburden stripped for the embankment construction. The Division calculated the necessary financial warranty amount to be approximately $8,177,000.00. Enclosed is a copy of the Division's estimate. This concludes the Division's third adequacy review of this amendment application. Please remember that the decision date for this application is August 15`h, 2010. As previously mentioned if you are unable to provide satisfactory responses to any inadequacies prior to this date, it will be your responsibility to request an extension of time to allow for continued review of this application. If there are still unresolved issues when the decision date arrives and no extension has been requested, the application will be denied.
