27. In the second paragraph on revised page 2.04-50, it is stated that Hubbard Creek and Steven's Gulch <br />will be protected from the effects of subsidence. Considering that Steven's Gulch is at the end of the <br />longwall mining in panels B-10 and B-11, can Steven's Gulch be protected from subsidence or will the <br />subsidence effects be mitigated? Please revise if appropriate. <br />This issue is resolved. The discussion on page 2.04-50 was revised in the June 1, 2010 submittal. <br />Section 2.04.9 Soils Resource Information <br />28. As BRL is aware, with any future surface disturbance, such as with methane degas facilities within the <br />proposed west mine expansion area, BRL will need to submit baseline soils information for the <br />proposed disturbed areas before approval of such facilities can be made. <br />BRL noted the comment. <br />Section 2.04. 10 Vegetation Information <br />29. As BRL is also aware, the operator will need to submit baseline vegetation information for those areas <br />proposed to be disturbed within the west mine expansion area, such as with methane degas wells. <br />BRL noted the comment. <br />Section 2.04.11 Fish and Wildlife Resources Information <br />30. With the proposed west mine expansion, please revise, if appropriate, the water depletion estimate <br />found on revised pages 2.04-85 and 2.04-86 <br />This issue is resolved. In the June 1, 2010 cover letter, BRL responded that the water depletion <br />estimate should remain the same. <br />31. BRL will need to submit information on the fish and wildlife resources as required in Rule 2.04. 11 and <br />in consultation with the Division, for those areas in the west mine expansion area where surface <br />disturbances will be proposed in the future. <br />BRL noted the comment. <br />Section 2.04.12 Prime Farmland Investigation <br />32. Similar to the comments concerning soils and vegetation, eventually, BRL will need to address a prime <br />farmland demonstration when surface disturbances are proposed for the west mine expansion area. <br />BRL noted the comment. <br />Section 2.05.2 Estimated Area for Life of Operation <br />33. Please update the acreages listed on revised page 2.05-1. <br />8
