This issue is resolved. In the June 1, 2010 cover letter, BRL responded that none of the requested <br />information was relevant to the proposed transferred permit area. The Division agrees. <br />4. As required by Rule 2.04.3(2)(a), please add a narrative to this section that supports land uses for the <br />current and western expansion permit areas. Please include the relevant narrative from pages 2, 3 <br />and 4 of Section 2.04 of the Bowie No. 1 permit application. <br />This issue is resolved. BRL added additional information on revised pages 2.04-1, 2, 3, 4 and 7 of the <br />June 1, 2010 submittal. <br />Please update Section 2.04.3(4), if appropriate, if Delta County now has land use regulations that <br />apply to the Bowie No. 2 Mine and to the transferred permit area of Bowie No. 1. <br />This issue is resolved. Page 2.04-7 of the June 1, 2010 submittal was revised to show that Delta <br />County has specific development regulations but not for postmining land uses. BRL was notified by <br />Delta County that a county review of PR-12 was not needed. <br />Section 2.04.4 Cultural and Historic Resource Information <br />6. Section 2.04.4(1) was revised to include the 2004 Grand River Institute report. However, there <br />appears to be additional information in Section 2.04.4 of the Bowie No. I permit application that <br />might apply to the transferred permit area. Please add the applicable Bowie No. 1 cultural and <br />historic resource information to Section 2,04.4(1) of the Bowie No. 2 permit application. In addition, <br />the Division understands that the 2004 Grand River Institute report covers the east side of the <br />transferred area since BRL anticipates surface disturbance from the construction of gob vent <br />boreholes. If surface disturbances will occur on the west side of the proposed transferred area, BRL <br />will need to cite the applicable cultural and historic resource surveys or perform such a survey. <br />This issue is resolved at this time. BRL will submit new cultural resource surveys when needed, rather <br />than use the cultural surveys that are now in the Bowie No. 1 permit application. <br />Section 2.04.5 General Description of Hydrology and Geology <br />7. Concerning revised page 2.04-12: <br />A. Please amend the list of maps in the second paragraph to include Map 8A. <br />B. In the 3rd paragraph, 4`' line, the relative directions of the streams should read "west, east, <br />central and south respectively " rather than "west, central, east and south respectfully ". <br />Please correct this sentence. <br />C. The following sentence (according to Map 9) should refer to the West Fork of Terror Creek, <br />rather than West Terror Creek. <br />D. The direction offlow of ephemeral drainages in the western portion of the permit area is <br />incorrectly described in the Sd" sentence of the 3rd paragraph. Ephemeral drainages instead <br />flow to the east into Terror Creek and to the west into Stevens Gulch. <br />2
