I, Obiections: <br />The Division received a timely objection from the following during the public comment period which <br />closed on June 23, 2010. <br />Dated Date Received <br />Objector <br />June 22, 2010 June 22, 2010 <br />The Commenting Parties (Anna <br />and Charles Sands, Marcia Jarvis <br />and Ron Tinsley, Carol and Jim <br />Thalman, Roy and Betsy Gill, <br />Bob and Betty Santee, and Dale <br />and Deanna Hockett) <br />Objection submitted by Jeffery P. Robbins and Josh W. Mack; Goldman, Robbins & Nicholson, P.C., <br />representing the Commenting parties. <br />II. Issue(s) Raised by Obiiector: <br />The issue(s) raised by the objecting party are summarized below. The issues are followed by the <br />applicable section(s) of the Colorado Land Reclamation Act for the Extraction of Construction <br />Materials and/or the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board <br />for the Extraction of Construction Materials. The Division then provides its response to the issues <br />raised by the Commenting Parties. Issues that staff believe are not within the jurisdiction of the <br />Division of Reclamation, Mining and Safety or the Mined Land Reclamation Board are listed last. <br />A. ISSUES WITHIN THE JURISDICTION OF THE DIVISION AND BOARD <br />1. Exhibit G - Water Information <br />Construction Materials Rule 6.4.7(c) - Submit a brief statement or plan showing how water <br />from de-watering operations or from runoff from disturbed areas, piled material and operating <br />surfaces will be managed to protect against pollution of either surface or groundwater (and, <br />where applicable, control pollution in a manner that is consistent with water quality discharge <br />permits), both during and after the operation. <br />a) "...the Applicant has not demonstrated that adequate plans have been made to address <br />storm water runoff. <br />Division of Reclamation Minine and Safety (DRMS) Response: <br />Page 2 of 7
