Recommendation for Application Approval Over Objections <br />Construction Materials Regular (112) Reclamation Permit Application <br />Thomas H. Smith <br />Eagle Mtn. Pit <br />File No. M-2010-019 <br />July 27, 2010 <br />Introduction <br />The purpose of this document is to provide a basis for the Division's recommendation for approval of the <br />Construction Materials Regular (112) Operation Reclamation Permit Application submitted by Thomas H. Smith <br />for the Eagle Mtn. Pit, File No. M-2010-019, over the objection to the Application raised by the Commenting <br />Parties. <br />The Application was submitted on March 30, 2010 by the landowner, Thomas H. Smith, and found to be <br />complete and considered filed with the Division on April 29, 2010. The proposed Eagle Mtn. Pit is located in <br />Archuleta County, approximately 3.5 miles NW of Pagosa Springs, and will be accessed from Cloman Boulevard <br />on the east side of the property. The center of the area where the majority of mining will occur lies in the SW <br />of Section 4, Township 35N, and Range 2W of the 10th Principle Meridian. If approved, the total permitted <br />acreage for this site will be 36.30 acres. <br />The proposed Eagle Mtn. Pit is a surface mine from which sand, gravel, and fill materials will be extracted by <br />conventional excavation methods and equipment. Materials will be crushed and processed on site. The <br />material to be mined will come from an unconsolidated alluvial deposit consisting of fill material, cobbles and <br />boulders. Mining will not involve the shale/sandstone bedrock. No blasting will occur at this site. <br />The proposed gravel pit is to provide materials for use in construction of the Dutton Creek Road, which will serve <br />as the primary ranch access to property owned by the Applicant, and possibly for the proposed Dutton Creek <br />development (subdivision or planned unit development). No material will be exported from the pit for use <br />outside of the Dutton Creek project, which is contained on lands wholly owned by the Applicant. <br />The current land use of the proposed site is rangeland, and it will be reclaimed as such. <br />Page 1 of 7
