• property is patented, meaning that the mineral and surface rights are privately owned property. This surface <br />property is not leased; therefore, there are no special covenants that a lessee must follow. <br />The proposed post-operations land use is to restore the property back to its current Mining District zoning <br />designation, resembling rangeland. Clear Creek county currently has the patented mining claims of this property <br />zoned M-1 (mining and/or residential). The segments of property that have been purchased and added to these <br />parcels via the BLM land purchase program are zoned M-2 (mining only). A copy of Clear Creek county zoning <br />regulations are attached at the end of this Exhibit D. It shall be noted that the only permitted use of M-2 zoned <br />property in Clear Creek county is MINING. <br />6.3.4(l)(e) <br />Mobile Mill Site Reclamation: <br />The bulk of the above outlined reclamation measures are specifically to be applied to the affected area denoted in <br />Exhibit E as the Tailings Impoundment (imless otherwise noted). The Mobile Mill Site requires a much less <br />involved reclamation procedure. <br />At the permanent cessation, or for periods of unforeseen temporary cessation, of Operations (as so described in <br />Exhibit C) the Mobile Mill Site will become inactive. All sources of acid producing materials shall be consumed by <br />the last stages of the operation or otherwise removed from the site. There shall be no remaining material (waste rock <br />and/or ore) on the Crusher Feed Pile, within the Crusher Feed Bin or Crushed Rock Bin, or lying on exposed <br />conveyors. Any waste rock and/or ore that may have spilled around the process equipment shall be removed. Any <br />collected concentrates shall be removed from site, shipped off to the third-party responsible for further <br />refining/treatment. All process water and tailings pipelines shall be drained down to the lined Tailings <br />Impoundment. In the event of bond forfeiture, any remaining mill feed shall be removed and disposed of in the <br />Tailings Impoundment. <br />As a pH treatment, hydrated lime shall be broadcast around and underneath all of the locations of the process <br />• trailers, conveyors, bins, and concentrate storage areas. The lime shall be broadcast at a rate of 50 pounds per 1,000 <br />square feet of such impacted area. Once broadcasted, a light spray of water shall be applied over the same. This <br />will sufficiently neutralize any trace, potentially acid forming material left behind. <br />Any remaining process water shall be sufficiently drained from the Ball Mill and Concentrating Table circuits of the <br />Ball Mill Trailer and discharged to the Tailings Impoundment, amounting to about 15 cu. ft. (125 gal.). This is the <br />same treated water that has been described ad nauseam in Exhibit C and D and does not pose any harm. It will <br />evaporate rather rapidly. <br />Also, any remaining process water shall be sufficiently drained from the Flotation Cell circuits of the Flotation <br />Trailer and discharged to the Tailings Impoundment, amounting to about 236 cu. ft. (1970 gal.). Again, thus is the <br />same treated water that has been described ad nauseam in Exhibit C and D and does not pose any harm. It will <br />evaporate rather rapidly. <br />It may not be necessary to drain the Water Holding Pond, provided there is no residual sediment collected on the <br />bottom. If there is any residual sediment in this structure, it may be collected and disposed of in the Tailings <br />Impoundment. Any remaining water (maximum water volume of 18,000 gal.) may be used for fire fighting or <br />drained dorm to the Tailings Impoundment via the double-walled pipe network. This is a remote location and the <br />nearest NFPA listed water source is in Idaho Springs city limits. It shall be noted that on the west end of this small <br />pond a very gradual "ramp" was incorporated so that any errant critters could safely escape. The lined surface of <br />pond is constricted using 60 mil textured HDPE Geomembrane which is rather rough and not slippery when wet. <br />At maximtun depth, the water level is 48". <br />Any containers of oils/lubricants that were previously stored outside, shall be re-located into one of the enclosed <br />trailers or storage units. Any containers of process chemicals (the same ones included within the list of 6.3.3(2)(a) <br />in Exhibit C) may remain stored within an enclosed trailer only after a thorough inspection to determine that there <br />• are no leaks. If any of the containers are compromised, the product shall be placed in a new container and <br />accurately re-labeled. <br />Page 5 of 9
