The revised Map F-3 has been improved over the prior version. There are two items on the map that must still be <br />added: the signature of the qualified person who prepared the map must be shown, and the correct permit number. <br />Please provide these items and the map will be adequate. The map includes reclamation contours, some of which exist <br />and others that depict the site after fully mining it. The contour spacing is too tight to reflect that the pit slopes are at <br />3H: 1V (they range from 1.5:1 to 2.2:1). However, the Division can accept that the proposed contours as depicted are <br />conceptual, and that the final slopes will conform to the narrative description, which is 3:1. No further revision of <br />topographic contours is needed, but you are welcome to comment. <br />Exhibit N - Right-of-Entry. <br />Evidence of right-of-entry for all lands to be included in this amendment has now been provided, in the form of a <br />memo from BLM. (This has resulted in a reduction in the number of acres proposed to be added under this . <br />amendment, which is a subject to be discussed below.) The memo describing the right-of-entry onto BLM land <br />included a legal description, but it appears that a slight correction may be needed. Within the legal description, the <br />portion of Section 4 should be "SE 1/4," not the NE 1/4. Please obtain a revised memo from the BLM which includes the <br />correction noted. Aside from that typo, there are no other adequacy issues to address on this exhibit. <br />Geotechnical Stability. <br />The descriptions of how the various areas will be treated and monitored are now much clearer, such that the Division <br />can assess each area and how it is stabilized. The exhibit is now adequate. <br />Receipt for Additional Filing at County and Recorder. <br />Submitting the additional and revised materials to this office requires that the same materials be filed at the county <br />clerk and recorder, and a receipt for that filing be submitted to this office before the decision date. <br />Extension of Decision Date. <br />The decision date was set for July 31, 2010. Your last adequacy response included an extension request, in case such <br />would become needed, for one month (until August 31, 2010. The Division will approve this request, but will review <br />and respond in a timely fashion to the operator's upcoming submittals. If responses to the outstanding adequacy items <br />are not received by the close of business on the new decision date, the application may be denied. If additional time is <br />needed to prepare and submit the adequacy responses, you may submit a written request for another extension. Please <br />specify the length of time being requested. <br />Upon a decision to approve the amendment, the Division will prepare and send to the operator an amended reclamation <br />cost estimate.
